Hi,
I’m after some advice, please.
Does anyone know is if it’s worth pursuing a claim for a 3 hour 40 minute delayed flight from the USA to UK in May of this year?
The flight was booked through BA, but operated by AA, and AA insist that I am not entitled to compensation as the flight was from the USA and not covered but the EU regs.

My question is whether, as I booked with BA, and my contract is with them, I should pursue this with BA?
I have tried the CAA and was unable to submit a complaint about AA. When I submitted a complaint about BA, CAA redirected me to CEDR. CEDR said that they cannot assist with a complaint about AA, despite me stating it was about BA, and told me to contact the CAA.

I’m considering giving up, but it’s frustrating going round in circles and seemingly being fobbed off at every turn, so it’s a point of principle now!

Claims can only be made against the operating airline, which appears to be AA in this case. Therefore they are correct that 261 claims can not be made1

AA operated flights would only be governed by 261 ruling for flights departing the UK/EU. It does not matter who you purchase your ticket from or even if it has a BA flight number...what is key is the operating carrier.

You could check your travel insurance policy but many of them only pay a token amount after a longer delay...eg £20 for each 12 hours (after 12 hour delay)
