Hi All,

finally received my questionaire by post. . I have located it online and will type my responses, I see the additional D1 suggested response is to contest it as below - however my case is different in that they stated I parked in a disabled bay without displaying a badge which had actually fallen. . 

My questions:

1. Should I add the below to my form

2. The  letter states to post it, Should I post this back or can I email it.

3. Do I send it to the court and both DCB legal and UKPC or just CBCC and DCB legal ?

4. Should I state 2 witnesses, as my Father was with me, who the badge belongs to or is it sufficient for me to be the only witness?


D1 wording as per q1.

"I am not content for the case to be heard 'on the papers' because that seems to disproportionately give an advantage to a legally represented party. I feel strongly after all these years of intimidating demands from this aggressive parking firm and their agents, that I need a voice at an attended hearing. I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.

    Advocate in the County Court dealing with a variety of cases, attending the courts in the North East and North Yorkshire

    I’m not sure, thats I’m asking does it still apply? .  I thought evidence of them seeing the actual badge may speak for itself. 
    Could you let me know your advice on the other points please.

     Evidence and the DQ are two entirely different things. The DQ deals with how/where you want the case heard, the evidence is not affected by that. So, if you intend to defend all the way, completing the DQ correctly is simply the next step.

    The DQ can ....and should... be completed and sent online

    If you are taking two witnesses to speak, then the answer is 'two' otherwise....

    This is covered in the first 12 steps in the Template Defence thread.  Best you re-read the 12 steps rather than stay isolated on your thread.

    Obviously you are not emailing UKPC direct.  People and companies use a solicitor for a reason.

    How many more threads are we going to see about this one parking incident?
    Please keep all comments about the one incident in to one thread otherwise people have to chase back looking for previous detail.

    Remember that checklist you were following when you filed a Defence?

    Well it’s not obvious to me and I didn’t see any checklist, so would be grateful if someone could send the link
     -  I went through the newbie sticky and searched N180 in the top, that’s where I got this information and just followed this and then a reply underneath had the added bit pasted. 

    I didn’t realise I should keep adding to old one thought that would be archived by now!

    Thanks, thats helpful will check there, didnt realise it had more than just the template as it’s been a while.
