    I finally found the courage to call them and the case has been stayed. What a relief! If they wanted to apply to a judge to have it reopened then does the judge have to read my defence in order to decide?
    This could-be un-stayed at any time behind your back.  Pretty much forever, I believe.  

    We've seen cases resurrected 2 years later and the person had moved house and not thought the case was still open - so they didn't tell the CCBC about the change of address - so the Defendant victim got a CCJ for failing to reply to paperwork.

    Awful, innit?

  • Hello ALL again!

    CST Law on behalf of ECP are now applying to have the stay lifted. I have been asked to complete a questionnaire in order for this to happen and to then go to court.

    I have been asked;
    1. Do I agree the small claims track is the appropriate track for the case? - what does it mean if I'm not / what's the other option?
    2. Hearing venue I would prefer to use, - I remember someone mentioning a good court to choose but can't find the comment.
    3. Expert evidence - am I asking for the court's permission to use the written evidence of an expert? - what might this be for my case?
    4. How many witnesses I will have? (I have a lot of other midwives and other health care professionals willing to attend court in support - a few of them have their own stories where ECP attendants have given tickets to people who HAD paid!)
    5. Asking for dates I'm not available - self explanatory

    Please do be mindful in replies that I'm here for help so please go easy on me.

    Remember that checklist you were using when you filed a Defence?

    You now need to be reading items 8, 9 and 10 on that list.

    One of the problems of having multiple threads about the same incident is that it becomes more and more difficult to find out what has been said before (and indeed, what hasn't been said before).

    On one of your other threads, at 25 August 2023 at 8:22PM you clearly knew where that checklist was.

    Strongly suggest you consider asking MSE to merge your threads - simply to avoid detail being lost.
  • If I knew where it was why would I have asked? There's no need to be rude or talk like that, it would take a lot less of your time.

    I have a lot going on outside of this so please respect that everyday people come here for help and may not need a constant jibe with almost every reply - I'm trying our best to understand and keep going with this. I already feel awful enough without the need for you to make me feel worse.

    You appear to have received an N180 DQ form, so follow the instructions for dealing with it

  • Thank you - I found it after a while, it wasn't coming up for me when I would try and search for it - only other people's threads.

    Do any of you think it would be worth while submitting my own N244 to see if I can get the order set aside and then try to amicably sort it out through my hospital Trust?
