Car Dealer sold me a faulty car

An auto dealer sold me a car with some noise on gears 1 and 2. I was informed y him during the drive test that this is due to stones in wheels and nothing to worry about. He told me that there is a 1 year of warranty. I bought the car from him and sent him a bank transfer.

During the first week, I started to have problems with the transmission, difficult to change gears and sometimes blocked.

I took the car to an expert that sent me a diagnosis report about worn bearings to be changed and clutch contaminated by oil and need to be replaced.

I rejected the car, but the dealer suggested to fix it then I accepted that with a good faith. He told me to tell the warranty company that the fault appear after buying the car but I didn't do. I instead explained to the warranty company what was happening exactly.

Following his instruction, I took the car to the garage he told me about. I took my car and after few days I collected it with the same gearbox issues, transmission changing problems and blocked especially at gears 1, 2 and R. I had a really risky and dangerous drive after taking the car from the garage.

I recorded a video about the transmission problem and sent it to the dealer and rejected the car directly. He sent the mechanic to collect the car and after 3 days, informed me that the car is good and I was lying. He is refusing to accept the car rejection and refund me.

I have received an email from his solicitor that I have to go to collect the car because the car was fixed and I have no evidence of gearbox problem after this had been fixed. They told me that the car was checked and has no problem.

Could anyone give me some help about that issue please ?

A bit of background information please -
    • What date did you buy the car?
    • What make and model, what age and mileage?
    • What sort of dealer - main agent, franchised dealer, car supermarket, small garage?
    • What price and how did you pay or finance it?

It sounds like the dealer is saying that the car is now fixed, so you are (finally) getting the car you agreed to buy.

Is that outcome OK with you?
  • Thanks for your reply.

In fact, I rejected the car after I collected it from the garage (it was a second rejection) because I had the same problem with the transmission when I drove it.

The dealer, after collecting the car from me, replies that the car is good and that I was lying.

I had rejected the car before for the same reason only 4 days after buying it after receiving the diagnosis report.

I bought the car on 27/07 from a private auto dealer (a family run business).

    I paid by bank transfer.

The mileage is about 94'000 miles.
