PCN LBC - Need help

So i've read up on the Newbies thread and i've drafted a letter following the legalbeagles suggested template to send to Excel Parking.
I'm going to attach a copy of my V5C as suggested for identification purposes but that is all.

However, it says that i should also send a letter to the solicitors that Excel Parking use, but i can't seem to find that information anywhere?
I'm also not sure what i need to include in the letter to the solicitors (i've never done this kind of thing before!) - does anyone have a template i could use please?

    What is the letter about?  Is it in response to a LBC?  Is it a SAR?  You will find the solicitor information on the N1 claim form if you have received that.

    Welcome. However, I have no idea what Legal Beagles advise. Our advice is to do exactly what it says in the second post of the Newbies/FAQ thread.

    As you are at LCB/LoC stage, if you need more time to consider everything then you can send the solicitor a letter as an attachment to an email, on or just before their 30-day deadline, to request a 30-day hold to get debt advice although no debt is admitted. If you don't need to delay and just want to get this over and done with a month earlier, just rebut the claim in the LoC asking them to provide all their evidence if they really think they have a case. No need to be polite but be robust.

    I'm assuming the first part of your post refers to a SAR to Excel. That is not your priority but it may come in useful later at WS stage.

    Here is an example of an SAR that has been used many times without needing any additional evidence supplied. However, a copy of your V5C is not a problem, as long as the address matches the one on the PCN/NtK.

    It already tells you what to say to Elms Legal, assuming that's who sent the LBC.

    Okay thanks for all the help so far!
    Now i'm on to the letter of defense stage, and it says that i should know my defense inside out by time i come to going in person... So my question is, how am i supposed to know it inside out when half of the defense template makes no sense to me? 
    Do i need to research what all the sections are, i.e. parkingeye vs beavis and CRA breaches?
    The letter is written in such a way that my mind is having trouble understanding it, can anyone please help?

    Yes, that's what you need to do.
    With any luck you won't need any of that. We frequently hear of cases where the Defendant hardly has to say anything but you might need to challenge things the Claimant's representative may say.
    Best to be prepared. Know your case inside out.

    And by the way, there is no letter 's' in the word Defence.    ;)

    IMHO it explains itself and is in plain English.  Just because it's long doesn't make it hard to understand, does it?

    I think it's hard to understand because I don't know what most of it is referring to. This is my first time ever dealing with anything like this so a lot of the words used, and legislation referenced i've never heard of.
    That is fine because as KeithP says, I need to learn what it all means and I can do that.

    I do have another question though, once my defence is submitted via email to CCBCAQ@Justice.gov.uk, I don't need to do anything on MCOL do i?
    I did read something about emailing the defence last time I was on here looking, but now I can't seem to find it, sorry.

  • Once your defence is filed, you only use MCOL as a reference to see when your defence was received and when they have sent you an N180 DQ. Everything is explained fully in the Newbies/FAQ thread and the 12 point-checklist in the first port of the template defence thread.

    The template defence is used by new posters who have almost all never done anything like this. It's always their first time defending a claim, just like you.

    EVERY new poster is in the same position and they all cheerfully read and 'get' what the defence is telling them and the Judge.  

    You are meant to read it through and follow what it explains to the Judge, including following the links so you know a bit about the Government's position.

    It then surely all slots into place and you understand the defence well.

    You must read and 'get' it first... it's not just a 'grab & go' template with no reading needed by the Defendant.

    Then you simply read the first post of the Template Defence - the first 12 steps.   
    Your last question is answered there.
