Hope you're doing well. I'm in a bit of a pickle and could use some advice about a letter I got from a court. Sorry if this message is a bit long, but I'd really appreciate any help you can give.

Back in October 2017, I got a parking ticket for parking on private property that belongs to the people who are now taking me to court. They say I broke the rules. The court letter says I was supposed to pay within 28 days, but I didn't, so now they're saying I owe them money.

Honestly, I don't remember the exact situation and whether I really did something wrong. So, I have a few questions:

  1. Seeing Pictures: Can I ask them for pictures or any proof to remind me of what happened? It would really help me understand what's going on and whether I should pay up.

  2. Ignoring Letters: I have to admit, I didn't pay much attention to letters from MET Parking Services Ltd and DCB Legal Ltd before this court thing. Now that I have this court letter, I'm worried. What should I do?

  3. What to Do Now: Should I just admit I did something wrong and try to work out a way to pay what they're asking? Or since I don't remember well, can I say I disagree and maybe not owe anything? Are there any good reasons I could use to explain my side?

I know this might be a legal thing, and I'm planning to talk to a legal expert. But your initial thoughts would mean a lot and help me figure things out better.

    Hello and welcome.

    Are you saying that you have received a County Court Claim Form?
    If so, please tell us the Issue Date on it.

    You'll get better legal advice here than from any "legal expert" you plan on paying for.

    Why on earth would you "consider paying" a speculative invoice for an alleged breach of contract from an unregulated private parking company?

    @KeithP has asked you a question so please answer it so that we can begin assisting. Also, you must read the Newbies/FAQ thread which will give you a better idea of where you are in this process. 

    As you are dealing with the intellectually malnourished DCB Legal, if it is a claim form you have received, then you will be glad to hear that if you follow the advice you receive here and defend it robustly using the template defence, it is more than 99% likely that it will eventually be discontinued.

    Please don't.

    Parking law is a niche area.  We know it inside out and we win cases. Solicitors don't have much of a clue.

    They won't know that DCBLegal discontinue ALL well-defended single PCN claims!  Really simple to win these cases and there will be no hearing.

    NONONO!!  You defend it. Dead easy even for incidents you know nothing about.

    Assuming you have a Court Claim Form please tell us the Issue Date on it. 
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    If DCB Legal are involved, you should read the following thread. It's not the green light for complacency, you must go through all the processes demanded by a court claim against you, but it does hopefully provide you with some confidence that you will come through this unscathed. Follow the plan.

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    HI all,
    Thanks so much for replying back to request.
    Please see the attached letter from CCBC which was sent to me.
    So far This is what ive done 

    A claim was issued against you on 08/08/2023

    Your acknowledgment of service was submitted on 24/08/2023 at 22:39:19

    Your acknowledgment of service was received on 25/08/2023 at 08:06:05



    and then I got in contact with DCB asking for Evidence (Pic no 2)

    and they DCB got back to me saying the following (PIC 1).They have sent me the photos of my car parked on double yellow line but I have asked them for a copy of the agreement with the copy they were working for.

    Please guide me what should i do from here.

    As I am quite tensed as they keep on increasing the outstanding balance.

    Its a lot of money for me to pay in my current circumstances.

    Your help will be highly appreciated.

    It's over five weeks since your last post here.
    At that time I asked you for the Issue Date on your Claim Form.

    With a Claim Issue Date of 8th August and having filed an Acknowledgment of Service on 25th August you had until 4pm on Monday 11th September to file a Defence.

    Maybe I've missed it, but I can see no mention of you having filed a Defence.

    Since 4pm on Monday 11th September the Claimant has been free to seek a Default Judgment against you.

    If the seek and get that Judgment before you have filed a Defence then they win the race - it's game over - you lose.

    Check your MCOL Claim History to see if there is already a Judgment against you.
    If there is then you can ignore the rest of this post.

    On the other hand, if you file a Defence before the Claimant seeks and gets that Default Judgment then you win this heat and go through to the next round and I suggest you aim to file a Defence as soon as possible.

    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Why did you go off-piste and contact DCB?  That ISN'T the advice.  You didn't defend?

  • Hi all,
    thanks for your guidance.
    Due to my ignorance and other personal issues going on in my life …..I wasn't able to send in my defence on time and as a result on 29th a CCJ was issued against me.(Still waiting for a letter to arrive )
    now beside paying, do I have any other option ? or just put in my experience book and pay ?
    Please guide I know I have messed it up this time.
