PCN DCB Legal

Hi All

I am a newbie and, as such, am reading the NEWBIES thread. However, while I get my head around it, I just wanted to ask one quick question in regards to immediate actions.

I will put full case details up at a later date once I understand the process more but, in short, I have ignored DCB Legal letters up to this point until now when I received a Claim Form from the Civil National Business Centre (with very blurry royal crest that makes it look like a scam) with an issue date of August 17th 2023. I know I now have to act, but wanted to check if it is worthwhile making an SAR request at this stage, as the 30 day period will run me almost up to my defence submission?

Thanks in advance - this community does great work (I initially thought upon receiving the Claim Form "that's it, I have to pay (£280), but now I have the confidence to fight)a

No, don't bother with a SAR.

You will win because the claim will be discontinued.  Glad you are here!

  • Thank you @Coupon-mad. Likewise with complaint to landowner/ retailers and other such steps before the 'If you get a court claim' section of the NEWBIES thread - just ignore all that and start from timely submission of AoS? thanks

You are the second person to use those words today.
Where did the words Civil National Business Centre come from?

With a Claim Issue Date of 17th August, you have until Tuesday 5th September to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 19th September 2023 to file your Defence.
That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

"The Civil Court Users association in a recent update has confirmed that as of 14 August 2023, the County Court Money Claims Centre (CCMCC, based in Salford) and the County Court Business Centre (CCBC, based in Northampton) have been replaced by the creation of the Civil National Business Centre (CNBC) at Northampton.

The newly-formed CNBC has confirmed that any new claim or application received at the CNBC prior to 1 September 2023 which bears the old name(s) of the CCBC or CCMCC will be accepted. Any outward correspondence from 14 August 2023 onwards will show the new name of the CNBC.

However, any new claim or application received on or after 1 September 2023which bears either of the old names and not the new 'Civil National Business Centre' name will be returned to the sender."

@KeithP thanks for joining and for the info. When I update with defence draft (up to para 4) I will try to add a redacted image of this letter so you can see the fuzziness of the royal crest - it could be mistaken by sceptical people as another scam tactic and dismissed

We don't need to see it. Normal for a claim.

No need to bother with that. We've seen 'the fuzziness' before.
But it's authenticity can easily be confirmed with a quick google of the address or phone number on it.

This thread might give you confidence to hold your nerve and fight.

Which parking firm?  UKPC (they've handed over a shedload of unpaid charges to DCB Legal over the past few months)?

Are you, or was your parking event, situated in Scotland?  I suspect not, but worth a quick check, as if so, it would put a somewhat different slant on things.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes UKPC and not Scotland. England.
