PIP Usual Request

Hi

I'm after some advice
If a case for review is with a HCP, and due to that process so far is causing serious psychological distress, increases in active suicide, is there anyway of contacting DWP and requesting they pull the case from the HCP and ask a Case manager to re review the claim themselves from previous evidence (20 years plus of it).

It's a review, not a new claim.

Even if they would delay the process for 6/12 months.

I'm not going to post here openly, but honestly, if this hell continues they will be destroying another life which they won't be able to put right.

I'm done with this system, I'm done fighting day in day out, and proving it time after time for someone who doesn't have any idea what it's like to wake up every day and not want to be here for someone to quiz you like a criminal.

Thank you DWP, I've never slated them once in 20 years but after the last week I've come to accept they don't care.

Sorry you’re feeling this way,  I trust youve a support network to assist you, if not then please contact your Gp.

I also appreciate that you dont want to say too much here and I dont want to put you through the whole situation, but i believe a little more info is required for others to help/advise you.

This is a review, I assume you completed the review paperwork and provided the DWP with supporting evidence?  Dont forget that the DWP do not have access to your medical records, only what either you provide or if they feel there is insufficant evidence the little they will receive from your Gp.

Have they advised you need an assessment, or have you already had the review assessment.  (From your post I feel youve had the assessment but dont want to assume this)

Cases are triaged - sorted into paper case or assessment If there is insufficient evidence then to make this decision then they will ask your Gp for extra evidence.  This can only be done if you have provided consent to share your records.  Sadly this also slows down the process and when they receive the extra info, it is triaged again.

In my time as a PIP assessor, I never knew of a case gong straight to the decision maker it went via a paper review or assessment.

If your getting multiple calls after the assessment, it may be that the report has been picked up for audit and returned to the assessor for further information, or in some cases depending on the situation it may take more than one call to complete the assessment.

If you haven't had the assessment is there anyone who can help support you through it. During the assessment they should recognise you’re vulnerable and accommodate this, but I know in reality this is somewhat left to the end of the assessment.

Hope this helps you to understand the process a little more and please reach out for support if you need to.

    ...

    Yeah I agree....

Unfortunately the Op has created a new thread when the history is in another active one https://forums.moneysavingexpert.com/discussion/6466966/dwp-telephone-call

I would say they are being treated without care... it's no surprise the current administration has just recently again condemned by the EHRC for its failing of the disabled including in regarding to claiming benefits and notably PIP.

It's very hard to advise in the circumstances other I hope you can get the support to get you through this time and hopefully if there is indeed a telephone assessment arranged that it is impressed on them that the process is something you are finding hard to engage. I do certainly understand the anxiety and stress it can all cause and I may well end up soon in your situation with my review in process... but you are acutely being impacted by the uncertainties and the demands they are choosing to subject you to. There must surely be markers of vulnerability/needing help in process. Make sure you seek personal support from those around or contact GP if you need help... unfortunately we cannot give medical advice here and it's difficult to know how to assist with your anxieties etc as it seems likely inevitable associated thoughts will persist until you get closure on this review... and we know due to delays in the process timescales are up in air. There's probably a very good chance you'll continue to get PIP after this review is completed... so hopefully you can stick with it.

Thanks for your reply, I appreciate it.

I've been involved with the mental health services for over 20 years, and been detained a number of times under emergency powers by Police but the mental health services have said they aren't sure what else they can do for me, I am highly medicated on various anti depressants and anti psychotics.
My condition has only worsened in 20 years, I've never had a week go by where I've been stable.

As such, I was discharged and the mental health service have stated if my GP ever needs assistance for them to make contact.

I haven't had my review yet, I've been waiting for the best part of 2 years since the form was returned.

They tried calling unannounced via phone the last week, then yesterday they contacted one of my carers who they quizzed, stating if I was suicidal now and if so why I hadn't completed that.
They also said do I eat, etc and what weight I am.
They then said that due to how my condition has changed, worsened I need an appointment but they felt a face to face was not appropriate given my issues and would arrange a call.

What was the point of them phoning as she even said that she wasn't doing the report.

What questions are those to ask someone.
Is that what it'll take for the dwp to accept my circumstances, suicide.

I've no life, I can barely drag myself out of bed, most days I can't unless someone makes me.

I was homeless due to my mental health issues earlier this year and if they cut my money now I be homeless again, and that's not something I cope with.
I've had 0 support from GP because they tell me they have ran out of ideas, after over 20 years trying different drugs.

Every night I go to bed hoping tomorrow I don't wake up, some nights I go to bed feeling so unwell I believe I won't wake up (chest pains, palpitations, feeling faint) and when I do wake up I wish I hadn't.

I went from DLA lifetime award to being put on pip and reviewed every few years.
This isn't fair, and it's definitely not something I can cope with.

If the DWP want to come and see me and how I am for a day they are welcome, I'm in tears most days.
I don't have enough to live now even barely eating, due to rising rents and bills so if they take the little money I get which covers it and my carers that's me done for.

If I have to take this to tribunal I won't manage it, because for however long I wait for the hearing I have no money from pip to cover carers and the other costs.

They've had 2 statements from carers given to them, GP evidence, mental health letters yet still I'm treated like a criminal, like I'm lying.

The DWP have already been contacted after the phone call telling them that I am vulnerable and they are risking serious consequences if they continue with this line but what notice they'll take I don't know.

You know when someone is already down so low, why would anyone kick them when they are there.

Another sleepless night for me, in tears all because someone who doesn't know me or how I struggle every single day asks stupid questions like why if I'm suicidal haven't I already done it.

It's just all too much, I'm watching my dad slipping away from me and now I have this on top.

Thank you DWP, because it's not like they don't know the full facts, social services told them years back I'd never cope with life independently yet here I am having to fight for something I'm entitled too.

I wondered if the DWP would reconsider doing a paper based decision on the available evidence, which they would have enough they were given 50 pages of supporting information and examples.

I just want a break from this hell

    Up all night, in tears.

DWP were contacted and my case manager made aware of the concerns, along with how its affecting me.
DWP were sympathetic saying it wasn't them who phoned and it's the HCP who did, which we knew already.

They advised to make a formal complaint against the HCP given what they've been told about it, and also to get the MP to contact DWP.

HCP contacted, they've said the call was a triage call to see what direction to take the case, they've opened a complaint and also now removed the telephone call consultation request, and instead a request to base on paper has been made given serious psychological distress.
They were very uninterested or sympathetic saying its nothing to do with DWP any report and its on them to deal with it.

What chances do I have of having a paper based assessment now they've got all this information?
She did say given active suicidal tendencies it meets the threshold for paper based and that whoever phoned yesterday should of noted that instead of requesting telephone assessment.
