ZZPS + ECP

Hi forum,

In an address which I used to live I've had two letters passed over to me from ZZPS apparently relating to 'unpaid debt' and 'debt collection notice' off the back of a supposed PPC dating back to 2019 and the start of 2020. Any initial steps here please - SAR etc?

It threatens 'GCTT certificated Enforcement Agents' if no action is taken, wooo

Also worth mentioning is the address was wrong simply stating the fact it's a basement rather than the flat number.

    Sorry can you clarify - would you make the SAR then tell them to remove the old address (obviously not giving them the new one)? Also in the past I've made a SAR and I've been asked to provide a copy of my drivers license etc of which I'm sure they can use to correct their 'database'?!

    An SAR and a data rectification notice are two separate things. You must do the data rectification notice because if you don't and they still hold an old, invalid address for you, they could issue the claim to that address and you would not know about it until you find a default CCJ on your credit record.

    Why on earth would you not give them a valid address for service? Do you want them to get a default CCJ because you somehow imagined if they didn't have your correct address you'd be immune to a CCJ?

    For ID purposes, do not give them any form of photo identification. Normally, just giving them the VRN and PCN number should be enough but a few are obstreperous and demand additional ID, in which case a copy of your V5C logbook should be enough.

    If you really want to play mind games with the eejits, send them a copy of your driver's licence with the picture redacted like this:

  • Following the Newbie's Advice section to the T. Let's see what happens and whether the famous court letter will arrive separately. How ever the hell is this whole threaten people 3-4-5-6 years down the line with debt nonsense legal. God only knows.

    Everyone in England and Wales, including you, has up to six years to pursue a debt through the courts.

    As well as following the advice given above, is the address on your driving licence AND your V5C now up-to-date?  Real fines of £1,000 can be given by DVLA for failing to change this info.

    Update on this. I've had a response to the SAR from ECP. They've come back and said they previously fulfilled the SAR. May or may not be true as I don't have a record. I still want a copy. Are they able to refuse on the grounds that they had previously fulfilled the SAR and if so what are my steps please! Thanks

    They can theoretically refuse a repeat SAR but it really needs to fall into the excessive or unreasonable.  I would reply to explain why it is important for you to have an up to date SAR as there have been issues about which address they were using and when and you need to have a clear picture of the exact address used on all communications for a potential court case.  I would give them 7 days then complain to ICO.

    Just to follow up on this if I may, what if I have a preference for my SAR bundle to be posted and I instead I simply receive it via email - do I have any reason to complain to the ICO? I don't want an email copy. Just to add - what if it was say really big (like 500 pages?)
