Claim Form - DCB Legal - County Court Business Centre

Hi,

I've received a Claim Form from DBC Legal which I initially assumed was a fake due to the pixelation of the "Stamp / coat of arms" however it does look similar to other pictures posted here (see attached) - this form did arrive with the response pack, admission and defence counterclaim forms.

The only communication I have had with the Claimant is to confirm my address and serve a SAR / Subject Action Request to get more information to the images they have.

Are my next steps to prepare a defence? 

This is for exceeding a parking limit on a free to park carpark, I can provide more information if required but conscious not to share too much.

    THE CLAIM FORM ..... THE COMEDY OF ERRORS .... AGAIN

    1: DAMAGES
    There are no damages for UKPC, they are only the puppet employed to manage the car park

    2: THE STATEMENT OF TRUTH
    Once again, the now famous YASMIN MIA signs her life away claiming this a true ???

    The simple fact is that DCBL cannot substantiate damages let alone who they should be paid to.
    they don't want to say "admin charge" or "debt recovery charge" because they know the judge will dismiss these as they are a feeble attempt of double recovery.
    So now, it's judge mugging time using the word damages ?  Whose little pockets do the damages fake add-on go to ?   ..... DCBL OF COURSE 

    Terrible money scam and lies from a firm approved by the SRA

    UKPC signs are the biggest load of rubbish we see .... UNREADABLE.

    You are now in a game with DCBL and it's great fun to play with all their copy and paste threats and offers.  BE PATIENT, it will take a while for DCBL to cotton on that you are not a mug

    The very last thing DCBL want is a spanking in court and maybe Yasmin Mia being told by a judge ...... next time bring your toothbrush with you ???

    With a Claim Issue Date of 4th August, you have until Wednesday 23rd August to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 6th September 2023 to file your Defence.
    That's almost four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. 
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Please could you review my defence paragraph's below, I've omitted various identifying information however concerned I'm not playing the correct game so to speak.

    I'm also due to be on out of the country shortly, how / when can I approach this to the courts to arrange a suitable time for subsequent paperwork / hearings.

    I don't think that looks like a typical Defence.
    It is usually suggested that one needs legal arguments in a Defence and it is at Witness Statement time that 'the story' is told.

    Have you seen the template Defence yet?

    Can you please confirm that you did file an Acknowledgment of Service before last Thursday.

    Hey KeithP,

    Yes Acknowledgement of Service was complete I think on Saturday 19th - I've seen a template with section 3 to be filled out in your own words which is what I've copied above, could you point me to the template / examples just to make sure I'm reading the correct pages?

    Should I edit / remove the above from this thread?

    Looking at those PoC, I don't quite understand why you are narrating so much information. You are answering the PoC which is woefully inadequate. There is nothing in those PoC that suggests anything except an allegation that you have breached some unstated terms and conditions.

    All you need to do is state whether you are defending as RK and/or the driver and why you were at the location. Let the intellectually malnourished claimant prove everything else. Don't do their job for them. 

    You can then flesh out your evidence when it comes time to do your WS. We already know that DCB Legal will almost inevitably discontinue when faced with the rest of the robust defence template.

    I'm trying to get my defence paragraph sorted this evening, can I clarify something please.

    I have previously sent a SAR which they replied to with images of my car entering and leaving the carpark with a timestamp however they didn't include any pictures of the signs is this simply because with a SAR I can only request images of myself / vehicle?

    Previous replies mentioned a weak PoC - What makes it weak? Should it include the terms of the apparent breach?

    Is it safe to post the pictures I've received in the SAR of the vehicle entering and exiting the car park?
