  • Wow ! - FRUSTRATED MANC - they have withdrawn auto pay without posting clear signage in west agate street NCP - I thought it was the app not working - we currently have 18 PCN'S - one successfully appealed and 4 letters from TRACE debt recovery at £170. each. I have one successful appeal so far but now have to tackle the DEBT COMPANY as well as NCP.

Get your constituency MP to complain to NCP and to the BPA. Sharp practice and a breach of the Code of Practice (which requires additional signs to warn of significant changes like this).

That's easy. Try ignoring them for half an hour and see how you get on. Each day, increase the time you have allowed yourself to ignore them. Eventually over a period of time, you will find you are able to ignore them for 24 hours a day, every day for the rest of your life.

    (None meant).

Do however mention the threatogrammes in all your complaints.

Thanks again everyone! Keep it up.

I know you guys are hardened to this but wanted to frame the appeal in my way.

    PCN No. XXXXX

I am the Vehicle Keeper responding to the penalty charge notice issued to my vehicle by NCP. This is an appeal by the registered keeper.  Be advised that I will also be contacting my MP to complain about NCP's tactics and to the BPA and DVLA. Having updated your app you have a problem with your Auto Pay system (which we only found out later). You have failed to prominently warn motorists in advance, with extra signs and by letter and urgent texts that your AutoPay system was not working at this site.  We will be using this case as an evidence example of 'extorting money from motorists' in our submission to our MP now that we've seen how you operate against long term app paying customers.

Due to your app failing to take automatic payment, no driver details can be provided. Please do not  try asking for driver details in order to get around the fact your NTK does not comply with POFA. If the appeal is rejected, please provide a POPLA code so the matter can be referred to them via the POPLA website. As the keeper you will be aware that liability cannot flow from the driver to the keeper.

    --END--

Yay glad this has worked for others.

  • Just as an aside, does anyone know why NCP might have discontinued the AutoPay function?

It used to be so easy to just drive in and drive out without having to open an app or decide how long you're going to stay and how much time to buy.

We have received 16 NCP Parking charge notices for my daughter who uses the NCP car park in west gate street Cardiff - first one dated the 9th December - she has been using this car park for a number of years without issue parking via the app and now she is getting daily fines ! She no longer parks in this car park and has to walk across the city centre to a side street to get her car after working late night shifts in hospitality which puts her safety at risk !
We will use the letter template to appeal and attach copies of all fines - thank you for all the info in this thread.

I have submitted the below appeal and had 14 PCN's cancelled - thank you that - the appeals were successful.

We have 2 more outstanding - ones submitted by my daughter. We now have BWLEGAL chasing and have received no response from NCP after filing a complaint through resolver and direct to NCP.

Looks fine and if BW Legal send a LBC, use the LBC response template.

Then after that, report BW Legal to HMRC for VAT concerns when they reply that "VAT doesn't apply" (...not correct. it does apply to the DRA fee!).  We need HMRC investigating the DRAs for this.
