Thanks all - defence amended as suggested and submitted. Auto response received :-) I see I can wait for the Directions Questionnaire to be sent to me or just be proactive and go ahead and download one myself. I might do option number 2 - any reason to do option 1? Also what's the timeline for submitting this? Waiting until the weekend would be the most attractive option for me!
It might take 6-8 weeks to receive the DQ from the CCBC, their admin is woefully adrift. But, just wait until you see your MCOL history showing the DQ has been sent before downloading. You will only receive a DQ after the claimant has received a copy of your defence from the CCBC and confirms they wish to proceed (they have 28 days to decide, and you won't know when they receive it from the CCBC).

The other point in not going too early with your DQ is that on it you will need to show the dates when you are not available for a hearing, so if your plans can change in the 6-8 weeks (possibly longer) from now, you won't have included them in a premature DQ.

    Wait ....!

  • Fabulous so for now....do nothing and monitor the situation via MCOL. That sounds like a much more restful option :-)

You had mentioned that DCB Legal often cancel these claims once they see a robust defence has been provided. Would it be at the point you mentioned above (when they have 28 days to decide if they wish to proceed) where we would expect to see the claim cancelled if it was going to be?

    Have a lovely day!

Much later on in the process unfortunately. If you look at the DCB Legal discontinuation thread, you'll see in the opening post the likely series of events they will progress through. It's nearer the end of that process a discontinuation might be confirmed. DCB Legal will write to you and notify the court.

As nothing in this game can be guaranteed, you must continue to follow the process required in defending a court claim - more to do beyond submitting your Defence.

You can't send it yet. CCBC will return it.

The DQ will be sent to you in about 2 months.

Hi all. Just a query. It has been just over a month since my defence was received. I have not yet received the N180 form. On the second post on the Newbies thread the advice says "Some days/weeks after filing your defence, the CCBC will send you a DQ N180 form, that must be completed & returned to the claimant and the court, explained here:" so I am wondering if I need to chase this up? I received today the directions questionnaire completed by Met Parking Services so I am wondering if I should have received mine yet. There's been nothing through the post, by e-mail nor in the MCOL portal.

No could be weeks away. When it says on transactional history that DQ issued to you, that is the time to log the DQ

Remember that checklist you were following when you filed a defence?

Item 7 on that list says...
    7.  Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire and the usual intimidating template letter saying they 'intend to proceed'. Nothing of interest there. Just file it.
Items 8, 9 and 10 on that list might be worth another read.

Hi all. Just filled out my N180 form and will e-mail it to CCBC on Monday. Step 10 of this thread https://forums.moneysavingexpert.com/discussion/6108153/suggested-template-defence-to-adapt-for-all-parking-charge-cases-where-they-add-false-admin-costs/p1 says to send a copy of the completed N180 to the Claimant's solicitor and that you can find an e-mail address on this forum. I have searched and the best I can come up with for DCB legal is on this thread (no e-mail via Google) - should I just give this a go? https://forums.moneysavingexpert.com/discussion/comment/79975612#Comment_79975612 - it seems as though poor Jamie is the only one who the poster has conclusively reported that their e-mail works so I would be sending to jamie@dcblegal.co.uk - Google seems to think he still works for DCB legal when I search that e-mail address - will this be sufficient?
