BW Legal - around 10 PCNs - what to do next?

    The Claimant also claims £120.00 recovery costs as set out in the Terms and Conditions and in the ATA AoS Code of Practice.
    Not seen it phrased like that on a Claim Form before.

    With a Claim Issue Date of 21st August, you have until Monday 11th September to file an Acknowledgment of Service.  Do not file an Acknowledgment of Service before 26th August, but otherwise there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 23rd September 2023 to file your Defence.
    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Did you confirm your new address?

    Was the CCJ in 2022 about the same place, how much did you pay and did you remove it in time to wipe that CCJ entirely?

    Yes i have done as you've said and confirmed my new address highlighting that I do not live there anymore, is there any chance to roll it back as i got the proof that i've reached out to them prior to that ?

    yes the CCJ from 2022 was from same place and ive paid around the same ~440 and yep ive paid it within a month so its wiped out

    Nope it can't be halted or rolled back but it can be defended and won.  KeithP has told you what to do and by when.  So you know your deadlines.

    First of all email the CCBC in Northampton and BW Legal and tell them both to ERASE THE OLD ADDRESS ON THE CLAIM FORM and update their data with the right address for service which is NEW ADDRESS.

    Do that today.

    Then search the forum for

    Henderson Defence.

  • i just have received another letter to my ACTUAL address quoting 3 PCNs for almost 700 quid, and issue date is the same 20 august, shall i proceed with exact same defence on those both cases?

    So you have received another letter. So what?
    The mere fact you have mentioned 'issue date' there indicates to me that this might not be just 'another letter'.
    Care to expand?

    I have received identical letter from court for another PCNs (3 of them), same format, same issue date, so yes its not standard letter its claim form
