Ah right okay, noted. I shall add that back in. Beyond that would everything else be okay?

And sorry to be a pain, are the further questions around Chan and Beavis parts all good?

The help is hugely appreciated. Thank you.

WS amended slightly to add access road sign back in, as per your comments @Coupon-mad

Please see this here - https://www.dropbox.com/scl/fi/fgalmqan8slz9kble9wft/WS4.docx?rlkey=fnyubxlhsldz3ddwbyivx1vxv&st=c0zpambl&dl=0

Would this now all be okay to be sent?

    Many thanks,

    Looks good!

But check back here the day before the hearing in case the DLUHC has by then released the final draft Impact Assessment, so you are up to date with the Government's view and evidence about the fake DRA fee DCB Legal have added.

Maybe DCB will discontinue this week, though.

    Hearing Bundle
I've received an email from DCB that 'The Court has ordered that both parties agree a Hearing Bundle' and they have attached the proposed bundle which includes both mine and their documents on file including Defence, WS, etc.

They have said I'm to confirm my agreement to this with a deadline of today. This only came over on Friday and I've just seen it, having been busy over the bank holiday weekend. If I don't reply they've said it will be filed at the court accordingly.

Is this normal procedure and should I accept upon review of it being the same as the docs I've provided and received?

Why would I not have been informed about this myself from the court?

Also, surely no one would be working today so the deadline seems unsensible?

Thank you in advance for any guidance here.

You need to make sure it is exactly what you produced and want.  If it was sent to claimant as .pdf, they should not be able to alter anything.

Yes this is normal and I'd be willing to bet it IS in the Hearing Order.

    Hi,

I assume I shouldn't expect to get a discontinuation at this stage with the hearing on Friday? Also have received a notification of a change of time and not received any sort of offer to settle from DCBL.

Is there anything else I should be doing other than preparing for the hearing for now?

    Many thanks.

They can discontinue right up to the day of the hearing if they want but that could lead them open to sanctions from the court if they were to leave it that late. You can always contact the court and ask if the hearing is still scheduled or has it been vacated.

However, if they don't discontinue, just make sure you are up to speed on the contents of your WS and you understand all the points of your defence. Prepare a crib sheet if necessary with any points you want to raise such a preliminary matters such a requesting that the claim be struck out for woefully inadequate PoC or abuse of process for claiming more than the original £100 in the PCN as required under PoFA 4(5) and so on.

Also put a reminder there to remember to ask fr your costs when you win. You'd be surprised how many people forget to ask for costs in their euphoria and so miss out on that extra bit of Schadenfreude.
