    What’s the alternative? C has overwhelming evidence against him compared to his defence against the case. 6 PCN’s of which most exhibit photos show D parking next to. His mum and dad are both terminally ill with cancer and he doesn’t want to have the stress of going to court and losing having to pay more money than he will if he settles out of court 
    But he'd PAY A LOT LESS (hundreds less) if he loses at a hearing!

    If he can't face that:

    Send Gladstones an email stating that he has 'vulnerable status' (and attach evidence of his parents' conditions, if he can bear to). Ask Gladstones to urgently revert to their client and invoke the FCA/CSA rules about 'breathing space'.

    Do that this week.  He should bcc you in so you know exactly what was sent and said.

    If he wants help to invoke that right to pause the case for reconsideration of his vulnerable family circumstances, tell him to ask his MP to send it on his behalf.  His MP will!

    DO NOT OFFER MONEY AT MEDIATION.

    You should take that phone call on his behalf (get him to nominate you) and mention the email and 'breathing space' and the fact that he will now involve his MP.

    I think they might fold.  If not, you could offer to pay one PCN at £60 to end the case, in 'full and final settlement'.

    But if course you must use the 2 phrases in bold first, not just go in with an offer!

    I don’t know the exact fee..but he’s got 6 PCN’s so if he loses at court he won’t pay as much? Do you not think if we write a heart sob emotional email they’ll agree on a settle off of say 60%? Appreciate you sending that breathing space info. I’ll speak to him and see what he says. I’ll know what he’s said as I’ll be helping him. I’ve done everything for him practically. He’s just worried about standing up in court when it’s all against him & I’m not there to speak on his before. So if he goes court and loses will be about £1200 for them all but if he settles outside and they wanted the full amount it wouldn’t just be the PCN it would be the court fees too they want?

    I've not re-read the whole thread so may have missed something, but do you understand that you or another person can be there and can speak on his behalf?

    A quick read of the Lay Representatives [Rights of Audience] Order 1999 should explain it.

    Probably no need to 'stand up' at all.

    And if it’s a bad judge? I remember seeing through the CCJ stages it was something like £1300 all together. Shall we just take them to court or do the breathing space idea? Will it eventually go court or? Cheers CM

  • So he decided to send the email I prepared beforehand about settling before I spoke you guys. I explained all the options to him and he felt it was all confusing despite explaining and saying I’d aid him. They’ve come back saying; 

    Whilst we of course have some sympathy with your current personal circumstances, we would not ordinarily accept a lesser settlement than that as claimed on the claim form.

     

    However, in recognition of your willingness to settle this matter ahead of the hearing listed for the 6th December 2024, we confirm we are prepared to accept the sum of £965 (£600 PCN's and £365 fixed costs) in respect of court numbers XXXXXX and XXXXXX if paid in full on or before the 27th November 2024.


    Is what it is, if it was my case I’d of fought it.
