    Just to check before I sent of the SAR to the solicitor - there's one line I wanted to double check is 100% ok to say, just wondered if the claim returned ''not at this address'' would the court still process the claim?

    Hi there,

    I am requesting if such a letter or email from the CCBC exists about unserved claim(s) and if so to have these letters sent to me - and a copy of the supposed soft trace that Gladstone’s say was returned in 2022 as well as a screenshot of the 'case history' dates and actions held about my case on your ‘case management system' for both claims (personal data of employees redacted). I urgently request the two letters addressed to myself to be sent to me without delay. I also request your case history notes which outline the following:

    - showing exactly why Gladstone’s did a sudden 'soft trace' just days after posting a letter to the old address

    - showing what Gladstones did when they got the letter from the CCBC telling them that one/both claims had been returned 'not at this address’

    - all of the 'case history' dates and actions held about my case on your 'case management system' for both claims (personal data of employees can be redacted and any notes of actual legal advice to their client can be redacted).

    They used to teach this in school!  It is:

    He also needs to attach ID and start:


    Dear Sirs,

    This is a Subject Access Request for documents that include my personal data.  The claim numbers that identify me as the data subject are xxxxxxx and xxxxxxx and as ID I attach my V5C which as you know shows my current address that you say you traced.

    The data and documents containing my data that I require are as follows:

    1.  I understand that the CNBC had at least one of the two claim forms returned marked 'no longer at this address' and thus they will have sent you a letter saying that at least one claim form was returned and to re-serve it. I am requesting that letter and an image of the returned letter/envelope if it was attached by the CCBC. If there were two CCBC letters I want to see images of both, inc enclosures.

    2.  I understand from the new resident at my old address that he also 
    returned the August 2022 letter, marking the envelope 'gone away' or 'no longer at this address' (or similar). I want to see that returned letter and envelope.

    3.  I understand that 
    Gladstones did a soft trace after the August letter bounced (in Sept 2022) and I want to see what data was returned. A full screenshot of the CRA trace will suffice.

    4.  I also require a screenshot of the 'case history' dates and actions held about both claims - pre and post litigation - on your ‘case management system' (personal data of employees redacted).  In particular, all notes about addresses and all notes about letters that were returned, including the claim form(s) and the reasons for, or your case management system notes about, what was then done, after each letter bounced.  The only information (apart from names/contact details) that can be properly redacted is actual legal advice given to your client, of course.

    This is a SAR so I look forward to a timely and full response or I will report Gladstones to the SRA and the ICO.

    P.S. I never had the same Judge but @bargepole has because he's lay repped loads more cases than me.

    PPS.  The Defendant needs to know the main basis of his defence so he can answer if asked. Do not do a defence yet.  He can say he hasn't even seen the claims so can't respond to allegations until served, but his defence would be based on no breach, inadequate signs, inflated quantum and Civil Enforcement v Chan (these claims should be dismissed anyway).

    PPCs always claim discounted rate/full rate pcns and court claim letters were sent to motorists but no proof is offered. As operators CHOOSE NOT to provide evidence of their posting we must continue to press gov to ensure they do and include it in the new Parking CoP. Please sign/share @jmccabe petition closes 22nd june 2024.

    @Coupon-mad update - they’ve sent out 2 letters to his address. Both letters are the apparent “2 LBC’s” but again the dates and times don’t add up but I’ll see what you think. They must of sent this anyway as he only requested the SAR 2 days ago, no way they would of posted it out that quick. 

    Also noticed Gladstone’s said they picked up the case from UKPCM on 30th August yet the letter they’ve apparently sent is in July. How they doing that when they didn’t represent UKPCM at the time? Again the dates don’t match up. Looks like it’s clear they got a “undelivered result”

    Say all that at the hearing and ask for his 2 x £275 fees ordered to be refunded by UKCPM.

    2) They apparently did a trace between 8th and 16th July to find a "new address" but on 31st August they apparently sent the other LBC to the old address; even though they had the new address. 
    3) You have left a reference showing on the last line of the 16th July letter above; is this the same reference as the letter of 7th September 2022?

    Good points made. How weird that Gladstone’s would sent that out.

    Not so important on a forum (although it annoys me) but get your grammar right for any legal documents or submissions to court!
