  • Receiving a lot of spam calls from DCB legal today. 6 in the space of 4 hours. Quite unhappy with that actually because it's annoying and probably amounts to harassment. They aren't even leaving a voice message.

    I sent them an email to respectfully p*ss off and that they need to appreciate people who work night shift etc that could have their already poor sleep quality deteriorated further. I told them it could even amount to harasment.

    Finally, I told them at minimum, any correspondence from them needs to be written but that I have nothing to talk about. I recommended that they quickly serve the notice of discontinuance and save themselves the hearing fee

    Regarding the claim which has been transferred to my local court.

    just received an email from dcblegal “ WITHOUT PREJUDICE SAVE AS TO COSTS

    they want me to call them, which I obviously wont.

    is it worth me replying to this email again in the same way as I did before? (That I wont settle, and recommend they discontinue and save themselves a hearing fee)

    I told them I have no interest to settle and to refer to my previous email. I said that their actions have been bullying in nature and harassing. Also, that thanks to their help and similar other firms, the pressure on the court is really high and is operating months in delay, and that genuine small claims cases are being significantly delayed.

    i made a note to tell them that I have submitted my evidence against them by name to the Parliament Inquiry regarding the “Work of the Court”.

    I suggested they save themselves the hearing fee on all 3 “unsubstantiated” claims they have against me


    I hope I haven’t said anything above which I shouldn’t have?

  • RE the claim which has been “Case Stay Lifted”: I received a letter to the house Without Prejudice Save As to Costs. They mention that I didn’t include a contact email or number and that I need to refer to civil procedures rules 1.1 and courts overriding objective in Civil Procedure Rules 1.3. Although my defence doesn’t include my contact details, my N180 does include these and they were cc’d in the email I sent back? Also they clearly have my details as I’ve been spammed and emailed by them for other claims?

    RE the claim that has been transferred to the court: I received a letter from my local court with a hearing due on the 15th March and the claimant has until 16th Feb to pay the hearing fee.

    And - more importantly - you have to do your WS & evidence bundle by a certain date/deadline shown on that Hearing Order.

    Ignore the WPSATC letter which is just lecturing you and trying to get you to crumble.

    That's right, I forgot to mention. Deadline for WS is 2pm of February 1st.

    How many hours roughly does it take to get a good one written up? I only ask because the next 14 days will be absolutely crazy for me with a huge amount of travelling and work, leaving me with around 4 afternoons before the deadline.

    I took a look at the NEWBIE thread and it explains that it's quite straight forward, but want to be sure so I can get my priorities in line and find a way to tackle this in the meantime.

    About an hour (one evening while watching Corrie or Eastenders or whatever!) because you simply grab one of the recent example WS in the NEWBIES thread and paste it into a Word doc, then change the signage photo exhibits and facts paragraphs for your own but keep the rest.

    Then sign & date it - add your exhibit PDFs in number order and save the document as a compressed and merged single PDF so it isn't too large to email.

     The NEWBIES thread even gives you an a - f exhibits tips checklist.
