You don't need that para 31 because the Template Defence already smashes home the point about the added fake costsz
ABSOLUTELY REMOVE THIS - eek no!
"Since there were no visible signs in the area between parked car and the entrance/exit of the car park that mentioned any details of a potential contract, it was believed the car would “be OK there for 20-30 minutes”. Details of the area are available, including a map and photos of the various views from the car location and entrance."
Happy with this now so I'll get it sent out on Monday. Big thanks to everyone who's helped so far!1 -
Great! One more thing please...While your case is quiet ... we need evidence photos please! From friends & family too. Think if this while out driving or walking around your town.
The Government released a 'draft Impact Assessment' ten days ago and it has some useful analysis about the fake added £70 'extortion' that enhances claims.
All discussed here:
https://forums.moneysavingexpert.com/discussion/6463361/dluhc-private-parking-code-government-launches-call-for-evidence-discussion-thread/p6
That's page 6 where I summarise what evidence is needed. We need YOUR photo evidence please...but not of the car park in your claim. Nope! You want to help us change the law?
To be clear, we are nearly there; it's not a petition or some weak campaign, it's a final push on a law already passed, to cap the £PCN levels and ban the fake DRA fees.
The Government has a Call for Evidence open right now.
We are wanting photos of unmanaged car parks, Hospital car park signs near you that show £50 or £60 as the deterrent, and Aldi, Asda, Tesco or Sainsburys £70 signs please.
We need photo evidence of low or no deterrent car parks near you, please!
NOT £100, NOT £90 or £80.
Just signs that are less - or places with no PPC. You will see examples of the photos needed, later in the linked thread as the response has been great so far.But we need more.
Thankyou!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

"The driver was visiting an adjacent hotel to view a wedding venue and mistakenly parked at the wrong hotel."
It may be better to just say:"The driver was visiting the hotel to view a wedding venue. There was no signage to indicate that the parking location did not belong to the hotel.".

That's a good way of putting it.
The real issue was the original draft basically saying 'we realised we were in the wrong place but assumed we could get sway with it for half an hour'!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Perfect, that's true. You could have looked at both hotels that day.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi everyone, brief update my end regarding this - as I'm not sure if there's anything else to chase up at this stage...
- Sent my original defence via email on 14th August.
- Received the parking company's copy of the directions questionnaire (N180) approx.. 11th September.
I should have had my own copy of N180 forms to fill out by this date right? - Sent an email query to ccbc@justice.gov.uk on 25th September to ask if they can send another copy of the N180 questionnaire forms since my original ones had obviously not turned up.
- Received the parking company's copy of their N180 forms and a letter titled "notice to proceed" on 21st October.
Because of this, and as it had been longer than the 10 working days the CCBC aim to reply to queries I emailed ccbc@justice.gov.uk again (same day 21st Oct) to ask them to look into my forms, and expressed my concern that things may be proceeding in my "absence".
Just a bit worried about getting a judgement in my absence if post isn't getting to me... Although I realise these things probably move at a leisurely pace...
Cheers,

What does your MCOL Claim History say?
Does it say that the CCBC have sent you a Directions Questionnaire?
If not, you have nothing to worry about.
The CCBC seem to be a couple of months behind with their processing at this stage.
Anyway, this is one stage where if the CCBC don't receive the expected response, they'll write again giving you a further seven days.2 -
FYI, you can download the N80 form here: https://assets.publishing.service.gov.uk/media/65200dcf244f8e000d8e7183/N180_1023.pdf
