Barclaycard claim under section 75

Hello everyone,
I am wondering if there are other people trying to make a claim under section 75 and have experienced the same frustration as I am having.

It has been months since I made the claim and Barclaycard has still not settled.  Instead, they are asking for more information from me and ALL communications that I had with the company which is no longer trading.

My frustration is with the fact that I have loads of emails back and forth with the company which has now ceased trading and the fact that the Barclaycard online upload system will only allow me to upload a maximum of 3MB at one time, for each time I need to upload a document, I must first complete their online form, then wait for their "special" secure link and then finally upload the file.

The problem is that for every time I go online to fill the form, I have to wait for their link to be sent to my email, which can take up to 24 hours to arrive!  I have about 40 files to upload!

I suggested that I would send them a link from my Google Drive so that they can access the requested info but they refused the idea.  Their reply was...  you can post the information to us.
My printer is out of use so I cannot print out.  Anyway, I don't see this method to be safe through the post, especially for the fact that the return envelope has the word CLAIM on it.

I filled their form three times today and have yet to receive a single upload link from Barclaycard.
Has anyone had a similar experience?  Is this acceptable?

I have been a Barclaycard holder for decades and I have NEVER missed a payment and I feel that I have been given the run-around.

Not had this issue but I haven't used my card for a while in any case.  But are you trying to do everything online or have you talked to a human?  There are ways to email some departments although I know it can be difficult.  You might find their social media team helpful - if only because you will be grumbling in a dedicated Barclays forum and they'll hopefully want to make you happy sooner rather than later.

I have talked to several humans, each time needing to explain the matter all over again.  They take notes but not follow through.  Unless I phone them, I never get updated on the claim.  I am really disappointed with Barclaycard!  I feel that I am not been treated well by them.

Regarding the social media... I am not on any of it hence why I post here.

In a way, Barclaycard want me to do things online but when I need them to be flexible they won't help.  I think my loyalty don't count and might be time to switch to a different bank that cares for their costumers once tis get sorted.

Stick with it - it may come good in the end.

I was caught up in a difficult situation during lockdown, where I was trying to claim from travel insurance, my holiday company and Barclaycard. They were all posted missing, didn't reply and gave me the runaround for months. I kept pushing and pushing and eventually got someone from Barclaycard who seemed to recognise I wasn't going away. She made me an offer and I was concerned it would be withdrawn if the holiday company challenged it, but she confirmed it was non-negotiable and wouldn't be withdrawn.

While I was annoyed at the timescale - I eventually concluded that Barclaycard behaved better than any of the other two. I never discovered if it was a section 75 settlement, or just a straight compensation payment.

You could always take Barclaycard (and the no longer trading company) to court if they continue to stall. If it is within the small claims limits then that limits the costs you are likely to face.
  • Oh, I will definitely stick with it until I get my full money back.

This should be a straight forward claim... I paid a deposit for a solar installation.  No goods or services were provided to me and the company is not longer trading.
I have the copy of the contract, Barclaycard statement showing what was paid as deposit.

I am just claiming the full deposit that I paid with the credit card.  Hundreds of people are in the same situation as me.  Really there is not much to investigate about.  I have read somewhere that some people got their money refunded under the Section 75 within days of making the claim with another bank.
  • Why are you making a S75 claim here? Did you leave it too long for a chargeback?
A chargeback would have got you a full refund fairly quickly as they didn't provide the items and are no longer trading.

Yes, the claim is months after I paid the deposit, as I was waiting for the work to be carried out but it never happened and no material was supplied.  Section 75 is the right claim for my case.

Banks tend to have very locked down systems which is why they cannot access file sharing networks like GoogleDrive. Would you be comfortable thinking that the telephone agent you just spoke to could be downloading all your account details (and everyone else they speak to) and sticking it all into a storage system outside the control of the bank?

3mb is a fairly large amount of space unless you are sending videos? You should be able to resize photos to a reasonable size etc and then stick files into a ZIP folder and up load that as a oner.

For future date issues such as this you have 540 days from date of debit to make a chargeback claim.

But is this just for the deposit, or did you also make any other payments via other methods.

Sadly there is no such thing as a simple or fast S75, as the bank is paying out of their own pockets, they want all paperwork. As they are being treated a equally liable & need to make sure that there has been a breach of contract or misrepresentation.
Months is the norm & a year is not unusual.

I don't see why I can't give the bank a link to access only what they need from my Google Drive.  My link could be inserted on one of their secure forms, then they would request access and I would grant it.  All done securely.

Instead, I had to spend days collating the info from emails for a period over a year of communication with the company gone bust.  The only way to provide the info was to first converting all emails to PDF, then fill in one online usecured form, then wait for an email from the bank with a link to a secure form, complete that one, attach a document to it, digitally signed and upload it to them.  The thing to remember is that it can take up to 24 hours to receive the secure link to the second form.

The upload can only includes maximum of 5 files at one time and the maximum size for all of the five files cannot exceed 3MB.

Some pdf documents contained 30 pages each and those pages had to be split in smaller chunks because the file was over 6MB.
It all takes time and it's stressful, especially as I didn't know at first how to convert emails to PDF and how to split one PDF file to smaller sections.

All I am saying is that the bank could allow for more than 5 files at a time, with a much larger size to be uploaded, all at once and by only filling one secured form.

Nowadays, when electronic information is measured in Terabyte, 3MB uploads is simply a ridiculous amount when the bank is requesting ALL communication between myself and the company in question.

Not everyone can easily do things online... It's second nature to some and a total nightmare to others.

I was advised by Hies to claim under Section 75.  I didn't know I could have done it differently.
