Delivery charge query

Hi. Some advice please. I live in Northern Ireland so i am used to shopping around or not getting items as they don’t deliver to NI. I bought some furniture from manomano this week. The website stated free shipping will depend on your postcode, this will be calculated checkout. I had to put in my postcode for delivery to be calculated. It calculated as free. I now have the seller requesting £100 for delivery. Do i have any options here?
I emailed back very politely advising postage was calculated and the info description on the website. They emailed back to say they use third party couriers and have no control over prices. When i originally tried to purchase from the sellers website directly the delivery charge was £100. So this would imply to me they are aware of the cost and as such should have been on manomano website? Am i right?
Thanks in advance for your help

  • Hello OP

You have to check the terms to see if a contract has been formed.

If acceptance has occurred, whilst sadly you can’t force them to honour the price, you may have a claim for damages, however the practicality of enforcing is likely unfeasible regardless.

If acceptance hasn’t occurred they can simply withdraw their offer without penalty.

They obviously can’t force you to keep the order and pay the extra. :)

    Welcome to the Forum.

    Who is the seller?
You say you bought furniture from Manomano but later refer to the seller as separate.

Has the seller actually taken payment?
Your post reads as though you have attempted to buy but they say you have not tendered the right price.

If there is some kind of mix-up over the total cost they do not have to sell to you, annoying though that is. You can either pay the amended price including £100 delivery or cancel the order for a full refund of any money you have paid.

Also looks like they have 3rd party sellers as well.

  • Thank you for your responses. Manomano is a website which has third party sellers. Money has been taken from my account so i guess that means that acceptance has occurred.
So if delivery was calculated at checkout based on my postcode they can still come back and ask for money. They don’t need to honor the agreed price?
    thanks

I think acceptance has occurred. Looking at article 5: https://cdn.manomano.com/legal/terms-of-service/gb.pdf:

    7. When the payment of his or her Order is validated, the Buyer will receive an Order confirmation e-mail. This is the acceptance of the offer made by the Buyer.

So assuming there has been a confirmation of the order via email then acceptance has occurred.

The whole terms are somewhat confusing. The company (Monomano) appears to be based in France so I believe it’s not governed by UK Law, but it makes reference to CRA. The whole thing seems a tad confused. I also can’t find them on UK companies house and looks like a French company registration…

Manomano is a marketplace like Etsy. They say the T&Cs of the transaction will be those of the seller. Only you know who the actual seller is. We know nothing about them, not even the country they are registered in, so we can only give very general advice.

    Manumanu's terms of delivery include:
    • The Products are delivered by the Seller to the address indicated by the Buyer when he or she places his or her Order. The Product is the Buyer’s responsibility from the time it is delivered to this address.
    • The Seller can offer different delivery methods to the Buyer, directly to the address indicated by the Buyer when he or she places his or her Order and/or to a collection point.
    • The Buyer selects and validates the delivery method in his or her Order in the ‘Order delivery’ step.
    • The Buyer may choose between the different delivery methods offered by the Buyer (by carrier, by post or by another delivery method) and their respective prices.

This sounds like you and the seller negotiate over delivery methods and prices to reach agreement. For instance you might say '£100 is more than I wish to pay' and the seller might reply 'We send many orders to Ireland. If you are willing to wait until another shipment is due to go we might be able to deliver for £50.'

If you can't get agreement and the deal falls through you should be able to claim your money back. Manumanu itself is a French company, registered in Paris. Whereabouts is the company you are buying from registered?
  • It is homedetail limited. Looks like it is registered in Scotland.
I will see if we can negotiate a price for delivery

Always amused by the couriers who think large chunks of the Scottish mainland aren't on the mainland...

And if they don't deliver to Northern Ireland at all, why do they call it the "UK" mainland rather than the "GB" mainland?
