APCOA Station (ANPR) Penalty Notice - Surrey

  • @KeithP I am going to use that image. I have a zoomed in image and from standing point of view in front of signage, which looks really difficult to read. I have one image where there is a sign showing ANPR controlled car park and ironically, to refer to the T & Cs for information... which is inaccessible. What's more, the ANPR controlled car park signage is on the exit side, rather than entrance's side. So if a car were to pass the vehicle at the same time, it would not be noticable. Is this worth including? I don't have a great photo of this though.

    Thank you for this ObserverOfLife!
I have a similar situation re a penalty Notice issued by APCOA in a station car park ( separate thread under Lily10) so have been following your thread with interest. I have had the appeal rejection from APCOA and need to submit the POPLA appeal in another 2 weeks.
What you have written here is hugely helpful to me so I extend a huge thank you and will keep following this to see what happens.
    Great submission and good luck!

Just a heads up, losing doesn't matter:

You will both likely lose your POPLA appeals, if these were postal Penalty Notices (not windscreen PCNs - those are easier).

Most of these APCOA postal PN cases from stations are lost at POPLA but it doesn't matter.  Ignore them.  Times out in 6 months.

Your main possible winning point should be if the £100 PCN sum is buried in small print on the signs. That wins at POPLA.

Put this exact wording as point one, with photos that prove it:

From reviewing the signage, the PCN amount does not stand out on the signs, it is in small text and blends in with the rest of the sign. The PCN amount should be in a larger text, so it stands out and informs motorists clearly what the PCN amount is. Based on the evidence provided, I cannot conclude that the PCN has been issued correctly and due to this, I believe that POPLA must allow the appeal.

  • Thanks @Coupon-mad I had thought that might be the case but wanted to try and get an instant KO to close the matter. Ill include your wording as the main point.
  • Hi folks, just submitting POPLA appeal now - it has asked me why I am appealing.

Would I choose "I was not the driver or registered keeper of the vehicle at the time of improper parking"? Which is a bit of an odd grouping when registered keeper is separate to driver.

    Or do I choose 'Other'?
  • Per Newbies thread:-

"These then get saved as PDFs and uploaded to POPLA under OTHER (ONLY) ......"

    Other.
  • First debt collection letter from zzzp came through today. Aren't they supposed to wait till after the popla appeal?!

Safe to say I will ignore it.

    Good morning folks

POPLA have come back to say my appeal was successful!

The operator did not submit any evidence supporting their charge and said the burden of proof lies with the operator. They did not look at my evidence so no idea if it was any good!

Huge thanks to everyone for holding my hands through the process, you folks are superstars.

I plan on contacting DVLA and also request APCOA delete registered keeper's information.

    Thank you once again.
    Great stuff! Well done.

Please add the decision and a link to this thread, in POPLA DECISIONS and state it was a win against an APCOA Railway Penalty Notice.
Put it in that sticky thread and it gets seen more and helps more people.
