    It's difficult to advise on random potential 'loopholes'.  Let's start at the beginning.

    That appeal point has legs if they only have 2 photos.  Doubt it! Have a look at their evidence online.

  • Thanks, I have checked all the photos they have and there are a few more but they are all between 9:43 and then 9:48 - so should I appeal on the basis that there wasn’t sufficient time to show the vehicle was ‘parked’ for longer than 10 mins?

    Yes, but it's five minutes (consideration period) not ten.  Read the BPA CoP:

    Interesting the BPA haven't shown the new one to the Public yet, despite saying they'd updated the CoP with a new version on 1st August.
