Parking in Deeds

Good Morning Everybody,

I purchased a house in 2021 which comes with an allocated space behind some houses in front of where I live. Being a single car owner I use the communal parking (which is plentiful) right outside the property and never use the allocated space. I never marked it when purchasing the house which i realise I should have done.The parking spot is clearly marked in red on the deeds.

However one of the houses has claimed it as theirs and when I queried it with them they said it was included in their purchase when they purchased the house in 2022 ( a year after me). I have checked the deeds on the land registry and the space is definitely mine on the plans.

So my question is do the deeds always stay correct or the fact that when they purchased the house in 2022 (after i did) that supersedes the deeds?

    Have you obtained the deeds for the house whose owner is also claiming this spot?

    Of course not, otherwise they may as well be claiming your house as well! Have you actually seen their deeds? You can download them from the Land Registry if the neighbours haven't been good enough to show you themselves.

    Of course not, otherwise they may as well be claiming your house as well! Have you actually seen their deeds? You can download them from the Land Registry if the neighbours haven't been good enough to show you themselves.

    Thanks for the comments. I have downloaded them previously but the owners say the 2 spaces came with their sale. I have discussed it with them but not getting anywhere.
    But I think I might have to go back to a solicitor to get something formally drawn up to send to them

    So when you downloaded the deeds for your neighbours home did it show the two parking spaces? If it doesn’t then take a copy of your own title plan showing your property and your parking space and show this to neighbour, it might be all that’s needed for them to stop using your space. If not, then definitely contact your solicitor and get a letter written more formally.

    rp2023, I'd assume that they are just ignorant folk who have made a mistake. So act in a way that you are tactfully pointing out this error, and not getting bolshie - and I'm sure you are perfectly reasonable.
    You have a copy of your deeds. Enlarge the relevant part - the map showing your space, and the accompanying written reference to your parking space - and take it round to them. Ask them to show you theirs since you are showing them yours. Ask them nicely to point out on their deeds map where their 'two' spaces are.
    If you get nowhere with this, then phone up the Legal Protection group that you added to your content's insurance. You did, didn't you?
  • No need to be condescending.

    Get their deeds and check that the space isn't on them. Then you can show them both your deeds and their deeds. You could go round, or you could write to them.

    It would also be useful to have a clear idea of what you want. Presumably you want then to stop using your space, and for it to remain empty.

    No need to get legal yet, give them the evidence and explain clearly what you want to happen, and then see what their response is before deciding what, if anything, to do next.

    As others have said, check their Title Plan. It will cost you £3.00.

    If the space in question appears on their Plan, as well as yours, then there is a problem, but this is highly unlikely. The Land Registry Plans will show which property owns the space.

    Invite them to tea. Provide a nice cake. And show them both your and their Title Plans. They will find it difficult to argue with that. Then suggest they were misled by either their seller, or their solicitor, when they purchased their house, and that's where they should direct their complaint (if any) not at you.

    It may be that they do have two spaces and the mistake is which two - but the plans are definitely the place to start.
