Exactly, but without it being in the contract, it has no lawful basis or legitimate interest.
There's a reason why consumer contracts are deliberately excluded from the Late Fee Regs.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Wonder when BPA last audited these Group Nexus signs!
Scotland DD11 Abbeygate car park £100 pcn.The readable notices say unpaid pcn will be passed to our debt recovery agent you may incur additional charges, no amount specified.4 -
Oxford Road car park Reading, run by Bank Park as per this current May 2025 thread:

Goodness knows what it all says. Life is too short! But there's nothing in that gobbledegook 'contract' about agreeing to added DRA fees.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Image taken today by this poster:
https://forums.moneysavingexpert.com/discussion/comment/81482478/#Comment_81482478This is BHCC land as can be seen from the smaller sign above. The £100 is in large text but nothing readable about any add-ons (clue: it is hidden in the very smallest capitals font but not quantified as £70 or £7000.
Not a deterrent then.
And not part of the 'contract'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

PPS London Ltd with a tiny sign on a wall at a residential site, not on poles near the cars:
Nothing deterrent-like about the tiny mention: 'may incur additional costs' in the small print.

Dyl Kurpil used to be a copper but on the below evidence, his firm District Enforcement still can't manage to create a sign where the added £60 fake DRA fee is readable.
On this sign they have - unusually - quantified the added £60 fee 'extortion' but I could only just see that by zooming in on the photo. They've buried it in minuscule print.
Not an enforceable contractual term, then, and certainly there's no deterrent value to it:Easily eight or nine feet up in the air, as well, almost twice the height of a car:Taken from this 2025 thread:

P.S. the thread is worth a read:
DE saw their CCJ set aside in February then lost the PCN case without a hearing because there was no 'period of parking' on the PCN. This 'legal professional' can't even get that right then?!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Images taken this week show that the driver is oblivious to any DRA fee. Not a deterrent then:
