Hi, I bought a bikini top from a private seller. There was a picture and the description only said the brand (Wolf&Whistle). When it arrived it's a push-up bra.. I don't use push up bras (it's a 34DD so not needed) and I really don't like it, would this be a reason to return it as item not as described..?

Not being an expert on Bras or Bikini Tops, I can't really answer the specifics !! However, if the listing simply said 'bra', with brand name, I would think it would be 'as described' if that was what arrived. It would be up to the Buyer to ask further questions prior to purchase, especially if it's a grey area. Saying that though, speaking from experience, eBay would probably still force the Seller to accept the return. The downside is the Seller would possibly report the Buyer (as I intend to do in my case) for abusing the eBay Returns Policy.0

The two are very different.
The fabric usually used in bras is very different to that used for bikinis.
Is it currently on their website?
If it is, which section is it in? Lingerie/bras or swimwear?
What section within eBay was it listed in?

It's a push up bikini, there's a specific additional detail for this when you list a bikini/bra, but it wasn't filled in (it's optional).
It's listed under bikinis and it's clearly a bikini top (the clasp at the back is plastic) and the tag says "swimwear".
I can't see it on the website, I guess it's an old model.0 -

You can't see on the photo it's a push up, for me that's quite an important thing... but maybe it's my opinion. I would certainly never list this without mentioning it (especially on a 34DD size, we normally don't use push ups!)

Its a private seller and so their duty of care is lower than a professional seller. They cannot have posted false information but a gap in information isnt false information. If you (or whoever "we" are) dont like pushup then its your obligation to ask them before buying.
By all means ask the seller if you can return it but you are asking for their goodwill not any statutory right. Given the cost of return it may be cheaper to just sell it yourself0 -

If the description said it wasn't a push-up, then your item is not as described.
If I'm unsure of any aspect of an item I'm considering buying, I ask.
Poor descriptions and lack of photos on both eBay and Vinted is a pet hate of mine.
My opinion is that you are at the mercy of the seller to accept a return (for which you'll have to pay postage even if the seller agrees to a return).
Or simply relist it yourself with a fuller description and more photos.0 -

For it to be not as described you would have to point to an item in the description that was incorrect rather than just missing. Not to say that Ebay might not side with you anyway as they are a law unto themselves, but by the letter of the law it seems to be as described.0

Have you tried messaging the seller to ask if they'll take it back because it's push up? The worst they can say is "no" and some sellers are very helpful.0
