"If I pay the fee to request it goes to a judge for potential cancellation and that is successful, could they attempt to bring it against me again?"

    What?
When I called Nottingham business centre they said I could pay £108 to request the case goes to a judge for approval of cancellation without a hearing, or around £200 with a hearing. They said that now the date for DCB legal to proceed has passed, they (DCB legal) would (and could) also have to pay these fees to progress it.

I'm wondering whether it is worth me paying this fee to request it is cancelled by a judge?

On 24th July you said "I simply don't have the means to pay it" now you have money to throw away, how strange!
Thanks for your comment and support. Indeed, I lost my main form of income several months ago and I started work again at the end of August following a long struggle. I'm stil not there completely, but getting there

    No.  ABSOLUTELY a hard "no".

Never heard such a suggestion... you'd be paying to make their claim 'live' again!

It's over, the can of worms is closed.  If DCB want to open it later, let them pay.  Then they'll discontinue the case anyway.

This won't cost you a penny.
Ok, thank you. That is a really good point!

Yesterday however I received a notice of proposed allocation to the small claims track?! I can't find anywhere in the forum where someone has received one of these after the deadline has passed and they've been told the claimant is now too late, as I was told. What do I do?

The letter is dated 3rd October, franked postage date is 10th October, meaning the business centre took one week to post it, which feels like an unfairness.

Yep just means the case is open again, probably because the CCBC lost some paperwork and got it wrong.

    Happens all the time.

You know what happens next because the NEWBIES THREAD tells you.

Ok, well I enjoyed the thought it was over for a short while at least. Onto the next steps.

Thank you so much, I really appreciate your help.

Wanted to update about this - I received a court date of June in the post. A week later I received a letter DCB legal to request I contact them to arrange a settlement in order to avoid court (which I didn't do). Then about a month later (around mid-April), I called DCB legal who informed me that Highview had requested to cancel the case.

Considering what a mess it has been (it not showing online, then being told it had been closed once before, then it re-opened) i'm going to call them again to confirm as I still haven't received a letter, but it is looking promising.

It took nearly a year for them to cancel it.

Thanks Coupon Mad for all your help, it is really appreciated.

    Great stuff!

Don't call them. Email DCB Legal and demand a Notice of Discontinuance.  Then show it to us so @Umkomaas can add it to the disco thread.

    Names covered.

Have a look at the examples linked in Umkomaas' DCB Legal discontinuances thread.
