Speeding five

Not sure if this is the right place to post but I was flashed by a speed camera on a duel carriageway. I wasn’t in an area I know so was relying heavily on Sat nav which said 70 but I have been told the speed restriction on that road is actually 50. I did not see the signs but it was late at night
I’m not sure what speed I was doing but definitely less that 70 though could have been 60-65?
Will I get a fine/points? What are options to appeal if any? Tia

As per above ... but are you named on the V5C as the registered keeper? If yes then they have 14 days within which to get notice letter to you. (Day 1 is the day after the incident). If they don't (which would be unlikely, but has been known to happen) then you'd have a statutory defence that the notice was served out of time ... but you'd need to prove that. (The letter system is fairly automated so it's quite easy for them to prove when they sent it). If it's a lease or company car then the first notice may go to the lease company or employer ... it is only that notice which has the 14 day limit; any further notice (to you) does not have any such limits (except maybe 6 months after the incident date?).

(From memory) ... if the limit was 50 and you were doing 61 or less then you may get away with it. 62+ and you may get offered a speed awareness course (assuming you haven't already done one in the past 3 (?) years, in which case it would be £100 fine and 3 points).

Bear in mind that speeding is an absolute offence - there are rarely any mitigating circumstances unless you can prove that the speed limit indication at the time was at or greater than the speed you were doing.

And no, I have never been stopped or caught speeding in 30 years of driving and no speed awareness course.
I am just gutted and no excuse I was speeding but I was relying on my sat nav not looking for signs

Your memory is less than perfect!

In a 50 limit, action starts at 57, not 62. A course may be offered up to 64 mph.

What about over 64? A bigger fine?

Up to 75 you'll normally be offered a fixed penalty (£100 and three points).

If you don't accept the offer (course or FP) it will be referred to court, where the fine and points will depend upon the speed and your income.
  • I was once worried that a speed camera got me, but was not sure whether or not I was actually speeding. To put my mind at rest, as I have anxiety, I phoned the speed camera partnership in our area, who confirmed they have no record of my details.

It may sound odd, me checking, but it stopped me worrying about getting the points as I already had some.

But was your Sat nav up to date? - I often use mine when driving further afield to give warning of speed limits and cameras.

That means ensuring my Sat nav is updated on a regular basis.- I also know of some areas where 20 mph limits have been introduced but Sat nav still says 30mph

Oh right I didn’t realise you could do that. I have anxiety too and I am finding this very stressful
