Wrong registration at ANPR pay and display

This is all new to me and I've just joined this forum for help - and found useful stuff - thanks all.

My friends bought a ticket at the machine which covered the time of their stay in a private car park. They paid cash and put the ticket in the recycling when they got home. There is now a claim against them saying there is no record of their payment.  They have complained to the land owner - no reply.  They appealed to the PPC - no joy.  They asked the PPC for a copy of vehicle registrations - no joy.  This may be heading to court as they have received a "Final Demand".
They will now ask the solicitors for the P&D records. 

Can you please point us to the process for getting these facts, as it is likely that my friend made a simple error with keying in the registration.  The full P&D records will be the only hard evidence for either side.  How can we be sure that the PPC cannot simply edit the records?

Can you point to cases where this simple error has been accepted as reasonable defence?
Or is this case a no hoper?

    Welcome to the forum. You are past the appeal stage and at the useless debt collector stage. Have you written to your MP asking for their intervention in this scam?

    The PPC (which one?) will not help you until/if it reaches the stage of Plan D, county court claim. Once you receive an LoC from their solicitor, you have several options, all of which are pointed out in the Newbies/FAQ thread which you should study and keep referring back to.

    If it ever reaches the claim stage, you can put the PPC to strict proof that there may have been a keying error and that they must evidence the data they hold from that day at that location.

    Which PPC and what location? Which solicitors, if any, are involved at this stage?

    Well I hadn't given specific details because I've seen posts saying not to specifically identify the case (as these posts are followed by the enemy).  If it makes a difference to the advice of course I can be more precise! 
    The letters come from b w l egal.  They are claiming £100 plus £70 for debt recovery.
    The PPC are accredited to IPC.
    The car park and the PPC are in Devon and we are many miles away.  So would my MP take any interest or have any influence?

    I'd like to have the defence/evidence planned in advance of court deadlines because I'm often busy...

    Just state that the case is disputed and the keeper suspects a keying error and under the PAP for debt claims, the defendant has the right to request documents.

    As such, BW Legal must revert to their client and cough up the machine and/or app logs from that car park at the material time. Full VRMs already matched to other cars that day may be redacted but partial or unmatched VRMs (or indeed the VRM of the vehicle in this case, if it features) must be disclosed.

    See what they come back with.

    Which one of the 11 million new parking charges each year do you think the PPC, or do you think the legal firm, will spot as being yours?  Us guessing as to who it is will result in guesswork advice. 

    For some PPCs, we advise that nothing further will happen and to ignore everything, for others we advise to wait and see, for some we advise follow all the procedures and the claim will be discontinued, for the worst, we advise that a court hearing is almost inevitable.  Now perhaps you can see that putting us (by holding back on information we ask for) into guess mode, isn't going to be particularly helpful to you especially if we guess it's the first of the above, but ultimately it turns out to be the last of them. Think about it.

    I was only trying to follow advice seen on this forum, and certainly not trying to hinder you valuable helpers. Perhaps the accumulated knowledge could be added to a read-only topic - like the much referenced NEWBIES thread (searching for NEWBIES does not help find it - but I think I did :smile:)

    Don't worry. These are robo-claim scammers. Between them they issue around 35,000 parking charges a DAY!!!! If you or anyone else thinks that they have the time or resources to scan the internet, or even just this forum, for a hint that a case may be one of theirs and that they could then glean something that would make a difference, you are sorely mistaken.

    As mentioned above by the others, just provide the information we require in order to best advise you. At the same time, have a thorough read of the Newbies/FAQ thread to get a better understanding of what the whole process is about and where you are in it. You should keep referring back to that thread as it is your bible in how to handle the scam you now find yourself in.

    Your MP can always take up your case and write or better still complain to the PPC. You could also ask them to contact the MP whose constituency contains the car park where you received the speculative invoice for the alleged breach of contract from the unregulated private parking company.
