(Having had a four year lease extension hassle because our original conveyancer didn’t diligently check the freehold title of the property matched other paperwork I would applaud the buyers solicitors for nailing this down tight!!!).1 -
Musicology said:We are selling our house and almost at exchange point. My husbands middle name is not on the Title at the Land Registry. However it is also not on his passport so therefore matches that ID. The buyers want us to update the LR with his full name. Our solicitors want to charge us an extra £125 + VAT to do this. I've said no as I don't see the need due to his passport matching. The buyers have said if we don't then they will need a "statement of truth". Our solicitors now want to charge us £125 + VAT to draft the statement of truth.... I am loathed to accept this extra charge. My question is can we ourselves create a statement of truth document to cover the name discrepancy? Or should I just accept the charge and get the solicitors to change the name on the title? I know we could do the LR name change ourselves at no cost but this would take longer than if the solicitors did it and would therefore delay the sale. It's more the fact of the solicitors trying to get more money from us that is annoying me. Husband says we should just pay but I'm annoyed and think I could easily draft a statement of truth. Thanks in advance for any advice or opinions.Conveyancers generally sort such name issues out between themselves to confirm each party is who they say they are and can explain away middle name issues also. If they can do that it’s rare to update the register first in this way as you’re coming off the register anyway when the buyer gets registered.Everyone needs to be sure it’s all ok, including us, but generally that’s a confirmation between conveyancers first based on their knowing you well for example/seen the name evidence and us second. Might be worth having a chat to explore them satisfying the buyer’s conveyancer in some other way?“Official Company Representative

Hi guys, I am also having a problem with this. I am gifting my property to my son, no money involved. The solicitor has stated that my name on my passport and drivers licence does not match the title deeds as it does not show my middle name. He now wants £150.00 to sort this out!!! Can anyone tell me if this is really needed? It seems so unfair that the solictor i used to buy the property has not done it as I would have sent the same documents to her in the first place.0

I’d just pay it. Yes it’s annoying but it’s a minuscule amount of money in the grand scheme of things.0

Not entirely sure why they are wanting this. I sold a house a couple of years ago where I had completely forgotten to change my name on the Title with Land Registry when I got divorced (and therefore reverted to my maiden name). I just provided my solicitor with a copy of my divorce decree and they sorted everything out. I could provide that I was the same person as listed so it didn't make any difference0

solicitors like to dot the "i" and cross the "t", so that is probably why they are requesting it.1 -
