    Thank you for your email. If this is the public roads around the hospital – then this would be a Cornwall Council penalty charge notice it should explain who the issuer is on the ticket itself, as well as the nature of the parking infringement. If this is the case then they are responsible for enforcement on the public roads around the hospital. That would include any appeal you would wish to make. Saba are a private company and responsible for parking enforcement within the hospital grounds and would have an appeals process for tickets they issue.

    So, now that I have confirmation would I follow the appeal process?
    Here is the doubt on the NtK stating the appeal has to be done within 28 days of this parking charge.
    Is this the 8/06/2023, or the NtK on 13/07/2023?

    If it's the first the time has passed. It would have been 06/07/2023. If the second, then it would have been 10/08/2023! Right?

    You should respond by stating that the car was not within the hospital grounds, but the unregulated private parking company, SABA, that the hospital trust has employed issued a parking charge notice to you. The hospital are responsible for the actions of their agents, (SABA) and are therefore jointly liable for SABA's breach of the DPA/GDPR who unlawfully obtained and processed the keeper's data. 
    Tell the hospital that you require them to instruct their agent to cancel the charge or risk legal action should SABA issue a court claim against you.
    You should copy in the head of the hospital trust.

    You should also complain to your MP, the BPA, and the DVLA that SABA have issued a parking charge on a public road outside the area where they are contracted to operate by the hospital.

    Hi,

    Here we go again.

    This time I find it "funny" that the Collection company ZZPS Limited is misleading people with a quote that "the Supreme Court ruling (ParkingEye -v- Beavis) has confirmed that a Parking Charge Issued on private land is enforceable."

    Parking Eye tickets are based on contract law, and tickets are issued for a breach of the contract. A contract is said to be formed by parking in the car park they through signage that communicate the terms and conditions. For example a sign may state the maximum stay to be 2 hours, and a breach of that will result in a charge of £100. By staying 2 hours and 15 minutes, Parking Eye will claim you have breached that contract, and therefore owe them a £100 charge.

    Unfortunately (for Parking Eye) it is not as simple as that. As we note above, since it is based on contract law, each case is determined on its own particular circumstances. In order to enforce the ticket, ParkingEye must demonstrate that the claim is lawful. There are many reasons why a particular ticket may not be lawful, although the Beavis ruling does mean the level of charge is now a much harder point to argue than it used to be.

    It is recommended that when faced with a ParkingEye charge, motorists should do research to find out about tickets issued in similar circumstances and find out how people are fighting them.     Parking Eye claim they win most court cases?

    Parking Eye have won many cases in the county court. They have achieved this by sending trained solicitors to argue the case against untrained and, often naive, members of the public. Irrespective of the facts of a given case, this clearly swings things firmly into Parking Eye’s favour. What’s more, is that Parking Eye can’t reclaim the cost of the solicitor – legal costs aren’t usually allowed in the small claims court; that’s the whole idea of small claims. As such, where a solicitor is used, ParkingEye make a financial loss on such cases, even when they win."

    Meaning, ZZPS is trying to use tactics to dissuade anyone from fighting and just pay.

    Experience tells me the opposite. 

    With the huge help from all the experienced Forumites, success is possible. I have not paid an unlawful or wrongly issued Parking Charge Notice.

    I know the ZZPS is considered a joke, and usually, it's a fruitless attempt at intimidating people to pay.

    Thanks again for everyone's input and patience with any mistakes on my part. All help is another "tool to add to my belt", to use at the right time.

    Secondly, as part of your DLUHC evidence, please firstly RING UP ZZPS this week, put it on loudspeaker and record their bullying on another phone.

    Do this only if you are a robust person who won't be upset by them.

    I really really really want more people to do that this month (urgent) and get that evidence recorded.  Stay polite but miffed and ask them how they justify adding £70 to a £60 PCN?  Get them to answer that.  Do not raise your voice.  Stay calm but say it looks extortionate.  Press them politely for an answer.

    Then tell them this was on public highway.  Ask them to "please help resolve my dispute as I have evidence".

    They won't help you but innocently try, and ask them to help resolve a genuine dispute.  
    I think they will bully you and tell you it's too late to dispute and they will just demand money.

    Record it.

    Calm I can definitely keep, as I work for a living as a Healthcare Professional with behaviours of concern (challenging behaviours).
