APCOA station penalty notice

A penalty notice was received in the post for railway parking which I thought had been paid on Ringgo - I do not see it on my Ringgo app.

How long do I need to wait before I appeal  - not clear from what I have read on the NEWBIES thread.

    When you say "Penalty Notice", do you mean a windscreen NtD?

    The keeper should appeal a NTK straight away, but should appeal a penalty notice where byelaws apply as late as possible without missing the appeal deadline.

    Use the template in blue text from the NEWBIES. Add a one liner that since the alleged event occurred on non-relevant railway land where byelaws apply, the PoFA cannot be used to hold the keeper liable so APCOA should cancel now and save themselves money.

    No appealing too quickly though!  You just need to time this out because it all falls off a cliff after 6 months. 

    So each appeal is done on the last day possible.

    This is discussed on every APCOA railway penalty thread already.  Read a few and you'll see how easy it is.

    Also they did show images of the vehicle,so in the template where it says they should show that, should I remove it?

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    Since the alleged event occurred on non-relevant railway land where byelaws apply, the PoFA cannot be used to hold the keeper liable.

    No, I received it in the post with title Penalty Notice. It is from APCOA.

    Also it is dated 13 July, so I should put in the appeal at about the 9th or 10th Aug?

    Leaving the template as is, or adjusting it to better suit your case will make no difference.

    I've adjusted my earlier advice. Normally there is no advantage in appealing later when you get an NTK, but since this is a fake penalty charge then by slowing things down you reduce the risk of the train company/landowner from taking this over. They are the only ones who can issue a court claim. Although this is unlikely, getting past six months means it would be impossible for this to happen.
