I received the following email from Eclipse Internet:
Dear Customer
I am writing to advise you of a change to your broadband terms and conditions.
From January 21st 2008 we will be increasing the charge from £47.00 to £69.99 (including VAT) if you cancel your broadband service before the end of your 12 month contract period. This charge will appear as 'early termination fee' on your final invoice should you cancel or migrate away before your contract ends.
I replied that I could not accept this. I was told that it states in their Terms & Conditions that they reserve the right to change the terms. I made the point that they may have the right to change terms but if I cannot accept the increase in charges then surely I have the right to cancel - penalty free.
I am waiting for a call back from Trading Standards - anyone have any idea on what the correct legal position is?
