Hi beeman - I was thrown by your opening post where it appeared MotorEasy were stonewalling you on processing your claim and were saying you knew about the problem before taking out the warranty.
The fact they're now sending an engineer out is a positive sign and it's very good indeed you have emails their insistance the car didn't need a pre-warranty check which could be your saving grace if that's a reason for denying the claim.

I think I'd wait to see what the engineer concludes and what MotorEasy's response is, it may go through without any issue in which case this thread is conjecture and hypothesis.

    Good luck!

Update. Suprise, surprise. MotorEasy has come back and declined the claim.

This is part of the report and why the claim was rejected.

" In our opinion, there is excessive noise present when the vehicle was briefly started, consistent with wear to the turbocharger central bushing. This would not be considered uncommon on this engine type and is well documented across the JLR platform, in which this same engine is utilized. Removal of the turbochargers would now be required to confirm their overall state. In any case, the condition is not the result of a sudden breakage. Taking into consideration the short amount of time and mileage elapsed since inception, we consider the conditions would have been developing at that point. Conclusion We can conclude that the vehicle is displaying common symptoms of wear to a turbo bushing. There was no evidence of any sudden component failure or breakage. The condition would have been developing at inception"

What the report is really saying is that the issue was already there before I took out the warranty. How would a normal know person know this? How the hell do these companies get away with this? Does anyone know of a route for me to take in order to escalate this?

I paid over £900 for this warranty, and their terms and condition doesn't state any of the above to be a reason not to pay out.

You need to go back to retailer using that statement from MotorEasy, that the fault was present at the time of purchase. As such you are rejecting under you consumer rights, as you are under 6 months from purchase.

3rd party warrantees have more get out clauses than items they cover.

OP says it was a Private Sale unfortunately.

In that case then. Not a lot OP can do, unless car was totally misdescribed.
Might be time to P/X against another car.

The car was a private sale.  To reject the claim due to not being a "sudden Failure" is a cop-out. 90% of faults in a vehicle are not sudden. A failure could be due to wear and tear which my policy covers me. What suddenly fails on a car, and how could they know if it was sudden or not? They didn't even inspect the faulty part. The fault couldn't have been know by me or the previous seller. The car was serviced 3 weeks before taking the warranty and it came back with no known faults.

This is the latest email I was sent from MotorEasy. It just seems they're contradicting themselves.

A turbo failing for whatever reason should come under the cover. The policy terms and conditions are written in a way so t they could get out without paying.

    Dear David

Your warranty is Motor Easy Plan A, which is our most extensive cover. It covers all mechanical and electrical failures, apart from a very small number of exclusions on this cover, which are clearly highlighted in the plan.

You can review the full terms in your account area or via this link:

    https://www.motoreasy.com/files/documents/15409-ME_PolicyDocuments_FullWarranty-A-211118.pdf

We have reviewed your claim but based on your warranty terms, we cannot cover the following failures under your warranty.

Your Turbo problem is not covered under your warranty because the part’s fault does not meet the definition of breakdown in your plan. As per the definitions section of your plan: Breakdown means the sudden and unexpected failure of a component arising from any permanent mechanical, electrical or electronic fault, which causes the component to stop working, and means that it needs repairing or replacing.

  • I have recently had a claim declined for the exact same reason.  They send out an inspector that works for them just because they know they need this to defend their case if it goes to court.  Unfortunately I made a massive error choosing MotorEasy as my vehicle warranty provider and I would not recommend them to anybody.

I forgot to mention that I am making good progress with the Motor Ombudsman and legal action, I recommend you do the same.
