PCS parking notice - didn’t receive first letter

    I find it quite amazing that such a self-professed prominent organisation doesn't know who the DVLA are.

    Ah OK, so it's that iteration of PCS, who are a parking operator, not a DRA.  Apologies - I thought it was the other PCS.

    Make a complaint (see the letter...) stating that no PCN was issued at all.  Say you are going to report them to the BPA and your constituency MP, for that alleged rogue conduct and you suspect this might be their pattern.  They are put to strict proof otherwise.

    do this in the morning and report back! What if they say the first letter got lost in transit or something like that? Just stand firm?

    If PCS so desired, they could have obtained a free 'proof of posting' certificate from any post office. You put them to strict proof that they did indeed post the original letter.

    That's exactly what they'll say - but you can ask for a copy, evidence from their 3rd party mail consolidator that the supposed PCN was posted (when and using what postage?) and a POPLA Code or you'll escalate the complaint.

    PCS Ltd have acknowledged and rejected the appeal and have resent the first letter which I didn’t receive alongside the Appeal Acknowledged letter. They state the PCN was correctly issued as the vehicle was parked in breach of T&C’s. 

    They’ve sent numerous photographs too. I now recall the event as it was a work event and the visitor bays I was meant to use were blocked so we used the general car park instead. This belongs to two different businesses, one of which isn’t the client I was meeting. 

    I’ve half a mind just to pay to save all of the hassle, or is this just usual practice here?

    I’ve been told I can appeal to POPLA if I believe the decision is incorrect but the “discounted rate” would no longer apply in that case. 

    Do I just hang tight now or just pay the discounted rate?

    Really?  Please don't.  People who cave in and pay are funding the scam.  The discount is a bribe to scare you, not a bargain.  NOT A SINGLE POSTER HERE WILL TELL YOU TO PAY.

    Thinking that it's not worth the hassle is the opposite of what good people should be doing.  The 'bottom line' of people who pay for a quiet life, is very different from mine. That's why I'm actively changing the law, which will help motorists like you, I hope.

    Government announcement due this month; I'm on the Steering Group that help-de to create the new statutory rules.  This has taken over 3 years of unpaid hard work already.

    Good change is happening, Why would anyone pay a scam ex-clamper right now?

    Appeal now to POPLA using the template appeal points (suitably tweaked to your situation) from the NEWBIES FAQ Announcement, third post.  When some PPCs receive the extensive detail of a forum-assisted POPLA appeal to deal with, they often give up. 

    But, even if they go the full mile, and you lose at POPLA, there is no requirement on you to pay them. It will need a judge to instruct you to pay.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
