Parking fine for the car I left where I've rented HERTZ Van from..

Hi, I've just opened a letter from the court. DCB legal trying to claim £176 (£261 incl court fees) from me for a parking charge.
In November 2022 I've rented a van through Hertz 247 app. The van was to be collected from B&Q car park. Obviously I had to get there by car, so I left my car in the spot where the van was parked. Parking charge have been issued but I've ignored it because I assumed it was a mistake. It should be obvious in my opinion that I need to leave my car somewhere while I'm using the van (it was roughly 6hours rental). Now I've received this letter from the court. Do I have to pay it now? It is not okay that they want me to pay..

Is it a N1 court claim form that you have received?  If so, what is the issue date?  Have you read the NEWBIE sticky that will inform you of the process and what you need to be doing and when?

Why on earth didn't you get B&Q and/or Hertz to deal with this as soon as you received the first Notice?

So you assumed it was a mistake.
It would've been sensible to have confirmed with B&Q and/or Hertz that your assumption was well founded.

    Who is the Claimant?

But I'm wondering if my situation is any different as I would assume that they shouldn't require me to pay for a parking if I'm using services from there.
Issue date is 16 jun 2023

Well tbh I didn't expect them to bring it to the court, I live bit far away from this place (b&q) but will be nearby tomorrow and going to pop in and ask if they can do anything about it. Hertz said they have nothing to do with it as the carpark doesn't belong to them lol and told me to contact b&q directly.

    Claimant is DCB LEGAL LTD

    Thanks

@Heklind , you "presumed" wrong about "them" taking care of where you left your car. Get over that bit. It isn't going to do anything to help you.

Luckily you are dealing with the intellectually malnourished, bottom-dwelling duo of UKPC and DCB Legal. Just do exactly as advised by the forum regulars, file the robust defence linked to within the advised dates and you can put money on a bet that this scamming pair will discontinue before it actually gets to court.

Here is a link to the defence template you should use for your defence as it has added points about the woefully inadequate PoC signed by their minion, Yasmin Mia. (Yes, we know that even though we haven't actually seen your claim form).

Have a read of this thread if you're in any doubt about the scammers not pulling out before court:

With a Claim Issue Date of 16th June, you have until Wednesday 5th July to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 19th July 2023 to file your Defence.
That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

Thank you for all the help.. I realised that I will have to attend hearing which will cost me a working day (more than how much they are claiming) but if there's a way to make sure they won't get a single penny from me then it's still worth.

I've already filed an AoS and now just finished modifying the Defence template to suit my case. As I understand I should only edit 2nd paragraph and remove 4th paragraph as I admited I was a driver in paragraph 2.

Is it safe to share the content of paragraph 3 here? I wanted to post it here to ask what you think about it and also for a future reference for anyone else in similar situation.

    You won't!

I think you have missed every single other DCB Legal claim thread outcome and @Umkomaas' thread all about what inevitably ends well-defended 'single PCN' DCBLegal claims.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, if you want others to see it and comment on it.
No, if you are happy with it.
