Refund My Money USA Company

Hi all,

Please could someone help.

I ordered some detox tea from a company called Lulutox which is based in the USA, when placing the order they offered 3 extra packs for £40 instead of pressing the button to leave the page, I pressed the order button. on realising what I had done I immediately cancelled the order for the 3 extra tea bags package following there cancellation & c & refund policy . The company emailed me back stating that due to the order being created a refund isn't impossible. I emailed them back referring them to there own cancellation policy & what it states, They emailed me back saying this time as the order has been sent out, they no longer can refund my money. I informed them that I had cancelled the order prior to it being sent out, so why did they ship the order out, if I have already cancelled it. They are refusing to give me my money back although I had cancelled the order as soon as i had made the purchase.

Is the USA consumer rights the same as England's consumer rights

What do I do to get my refund back

Thanks in advance

    Are you talking about lulutox.com?
Website registered this year in Iceland. Goods shipped from China. States governing law is Lithuanian. What makes you think it's a USA company?

Well, that's alright then!  Or was that your double negative rather than theirs....?

Even if it was a US company, consumer rights are defined by the laws of the country within whose jurisdiction the contract is formed, and these naturally vary from one country to another rather than being global.

It was a double nagative for myself

Came across this company on Facebook, so I just assumed that it was from the USA, but after doing more research you are right, it was shipped from China. so will I need to look up on Lithuanian or China consumer rights??

Nothing like it at all, and its not "USA" it depends on the individual state generally. One of the reasons for higher UK costs is covering the cost of consumer protection (along with higher VAT etc).

Or in this case, given it was the US, which State whose jurisdiction applies to the contract.

Wait to see what turns up... if it is what you ordered then you've little choice. You'll be required to return the unwanted goods to China which will be very expensive and the company will claim they never received them. A chargeback, assuming you paid by card, will require you to pay for their return before it can be actioned generally.

If something else turns up, or nothing does, then you may have more luck with your bank.

If you want these products pop down to Holland & Barrett.
    You will save a fortune.

Reminds me a Acai berry tea. Which was followed by many other products all offering the same outcome. A empty wallet....

    I agree with @born_again above.

The word 'detox' in the advertising blurb is a pretty good warning that a scam is about to follow.
