Civil Enforcement Limited - Letter Before Action - Claim For Debt

Good evening all,

I have received a letter from Civil Enforcement Limited (CEL) titled "Letter Before Action - Claim For Debt". It gives me 30 days to respond and contains an information sheet and reply forms including those that ask for my financial situation. Surprisingly or not, it does not say where I should send the reply forms (of course, I am not going to use them anyway). The letter is from the legal team at CEL.

By following the NEWBIES guide and advice in some other posts I have decided that I should do the following:

  • Send a SAR request by email to CEL (done)
  • Complain to the landowner (done)
  • Complain to the local MP (to be done)
  • Respond to CEL saying that I am taking a debt advice and need them to stop for 30 days (not sure if I need to do this)

If you have any comments or advice at this stage, I would be very grateful.

I will keep updating this post until my problem with CEL is solved one way or another.

    Hello and welcome.

    You seem to have everything under control. Well done.

    Just a small point... when complaining to an MP it is your MP - the MP that represents you in Parliament - that you need to complain to, not the MP of where the parking event took place.

    So the landowner has now responded to me saying that CEL has now canceled the the PCN as a gesture of good will (of course). Let's see if I hear further from CEL.

    I have a couple of questions though if you don't mind:

    - Do you think I can assume that this issue is now closed or do you think they may still pester me?
    - Should I complain to ICO if they do not respond to my SAR?
    - Should I still complain to my MP?

    You can assume that but be prepared for CEL to think otherwise.

    Log in pretending to pay CEL and it will state if the PCN is cancelled or not.

    I wouldn't worry about the SAR if it's cancelled.

    I would complain to your MP (this is vital due to the imminent law change coming). 

    Tell your MP that you hope you can count on them to strongly support the Government's new statutory Code of Practice and draft Impact Assessment now due to be resuscitated before the upcoming Summer Recess, PROVIDING it states what motoring groups have called for:

    i.e. that parking charges will be capped between £50-£100 (absolute maximum even in London) and that the extortionate 'debt recovery fees' are banned once and for all.

    And you are coming back here in August to take part in the Public Consultation in order for your voice to be heard, we hope?  We need high numbers of responses to get the new law over the line and the extortionate 'fees' banned.

    I did. It shows that the amount due is now £0 and that the PCN was cancelled. I took a screenshot. I just wonder if they can still change their mind... anyway, I will worry if this ever happens.

    Interestingly, I did complain to the landowner twice in the past (the last time a year ago) and CEL was not willing to cancel it...
