The deeds map you showed us earlier, any chance of a slightly wider shot of it, to show access roads?
No7 - as shown on that map - is your neighbour, the one you are having issues with? In which case the semi ringed in red is your place?
Anyhoo, one thing at a time: if the only access you have to your house wall is via the neighbour's land, then you ARE entitled to have this. You may need to 'force' them, but you are entitled. So what they said about you painting your wall is almost certainly wrong.

My property is the left in the photo. There is a passage between mine and the house next door. I have a back gate at the end of the passage the house doesn’t have a gate. My neighbour says the ivy was from my house. I explained to her it’s coming from yours. She then said I have no access to the passage as she owns it. I’ve never had any problems with the passage since 1995. She has now said she owns the passage but I own the roof over the passage? So I’m like who’s is the passage? Mine on the right side or hers on the left side? Or does nobody own it? Or is it shared?0

But where is the passage on the map (which is now upside down compared to the first time) ??Flowers98rac said:This is a closer up of the map
Am I right that the passage is yellow and the gate is blue?1

Yes it is, sorry for all this confusion0

Then it looks to me like the passageway might be entirely on your neighbour's land. Is there anything in your (or their) deeds/title/conveyances that says you have the right of access?
As far as I know, you have the right of access for essential maintenance of your wall, but that doesn't automatically grant you the right of access for any other reason.
If it is entirely on their land, and you don't have a flying freehold in your title, then it's their passageway, their roof and their ivy, that you can cut back only when it strays onto your land (which might only be the gate and your wall).1

Thank you very much for all this information. It has been much appreciated. The next problem is he’s saying that the roof belongs to me. My roof goes over the passage if you look at this photo. I just don’t understand why you would build a property where you don’t own the passage but you own the roof? So really what is the point in having a back gate which is no good because you can’t use it. Also if it is there passage am I within my rights to tell them to take the gate down because it’s hung on my wall? 0 0

Also if I own the roof her down pipe from her bathroom comes into my roof, so how does this work?0

In the photograph whose is the old gate covered in ivy and whose is the new gate shown?0
