Well, the dreaded Notice of Proposed Allocation to the Small Claims Track form has arrived. I have read the very useful post from Bargepole which explains how to complete the form, thank you! However, there are two additional questions on the form which aren't covered in Bargepole's post. I am okay with one of them but I would like to check the second. Please can someone help me?
Question D1:
Suitability for determination without a hearing.
Do you consider that this claim is suitable for determination without a hearing i.e. by a judge reading and considering the case papers, witness statements and other documents filed by the parties, making a decision, and giving a note of reasons for that decision?
Answer: YES / NO
Also, one more query, the cover letter says to return the form to the CNBC and serve copies on all other parties, does this mean I have to copy and send the form to UK Parking and their solicitors?0 -
