Letter of claim bwlegal

Can anyone please give me a straight answer as I do get confused very easily
date of contravention - 07/08/21
apparently I owe £160
I went shopping with my daughter and also had some coffeee and cake with her at this store and I parked in their car park but probably stayed over like 15 mins, without realising there was a time limit on parking.
I received a letter in the post saying I over stayed by 15 minutes and I had to pay £100. There was no option to pay less if I responded within 14 days. So I didn’t respond and ignored it. I’ve received numerous letters over the years threatening legal action. But I’ve never responded.
Now I have received a letter of claim.
What should I do.
I’ve been advised to ignore it by some people.
I’ve also been advised to start talks to come to an arrangement.
I don’t want to go to court but I also don’t want a CCJ against me. I have an excellent credit rating.
I don’t want to pay them on principle because they should not come in so heavy and charged me £100 for only being 15 mins late especially when the signs weren’t so clear.
Can anyone advise please.

    Hello and welcome.

The first few paragraphs of the second post of the NEWBIES thread explain exactly how to react upon receipt of a Letter of Claim.

    Which parking company is involved?

Where exactly did this alleged parking event take place?
Has this place been discussed before on this forum?

Welcome.  We see LBCs every single day.

We want to help - but what do you need to know that's not already covered in the LBC section of the sticky (pinned at the top) thread called 'NEWBIES PLEASE READ THESE FAQS FIRST'?

Please read the second post of that thread. It is standard advice and doesn't involve much of a response to BW at this stage.

But to answer your main points of concern:

I’ve been advised to ignore it by some people.
    NOT ADVISED HERE.

I’ve also been advised to start talks to come to an arrangement.
    ABSOLUTELY NOT!  No.
Who on earth said that, someone clueless like the Citizens Advice Bureau?

I don’t want to go to court but I also don’t want a CCJ against me. I have an excellent credit rating.
    SO HAVE WE.
NO-ONE HERE GETS A CCJ. OUR ADVICE DOESN'T PUT YOU AT ANY RISK OF A CCJ.

Please settle down with a cuppa and read the second post of the NEWBIES thread.

No link needed as there are two links back to page one of the forum, top and bottom of this page already.

Come back by the weekend and tell us how your complaint to the Store Manager or the Retail Park managing agents went?  That is always PLAN A and it's never too late!
And which parking firm it is who's bothering you?

Hi. I contacted the company - Dunelm and spoke to the manager, who has said he can’t do anything about it because I’ve left it too late and I should pay the £160 fine.
He said had emailed the parking managing agent G24 Limited and they aren’t willing to help me.

Apparently BW Legal will take me to court unless I pay.

What can I do? Please help

None of my advice has changed.

This is normal and resolving this dispute this year is exactly what you want - so bring on the court claim!

I signposted you to the thread and post to read.

@Zedcars, you appear not to have seen my post.

I asked several questions which remain unanswered and even gave you a link towards your next actions.

    Hi Keith,

This happened at a Dunelm car park in Huddersfield on 07/08/2021.

The parking company involved is G24 Limited and their solicitors are bwlegal.

No I do not believe this has been discussed previously on this forum.

I have read section 2 of the second post of the NEWBIES thread as suggested since I have a Letter of Claim.

I have sent an SAR to G24 Limited. This section also states:

    '
As well as the SAR to the parking firm's DPO, also write another email, if they are using Gladstones, DCLegal, BW Legal or other solicitor.
    Your email tells the solicitor:
    (a) I am seeking debt advice but I deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017.
    (b) I have sent your client a SAR
    (c) also confirm your correct 'address for service' if you've moved and the PPC has two addresses.'

With this claim being over 2 years old would it still be worth emailing the solicitor?

    Define 'worth'.

The solicitor has written to you very recently haven't they?
Why would you not respond to that recent letter?
Why exactly do you not want to spend a few minutes responding in the way the NEWBIES thread suggests?

Yes, that is what I wrote there. The advice is clear and suited to any case at LBC stage.  Glad you found it now.

Not sure why you'd think a standard retail park 2 year old PCN changes that advice?
All court claims we see here are about parking events between 1 and 6 years ago.
