  • Had a response from them...

'Having reviewed the evidence sent, I can confirm that it is our client's position that the PCN in question was issued correctly and remains outstanding. Please continue to follow the court directions as you see fit'

    Hmmmm...

Why are they pursuing it? Surely they have no chance of winning this now?

Nice!  The only change I'd have made would have been a sarky ending copying their patronising phrase:

"Should you be unsure of your position, you may wish to seek your own independent legal advice."

(save it for the last word, next time!).  :D

Ok - now send a reply that ends thusly!

Got a hearing date yet? You need to put this email exchange and your lease in as evidence beforehand.

  • Hi, shall I email them back or not bother?

I've just received my hearing date, 25th October.

I need to prepare my witness statement now and then submit this with the lease and email exchange by 11th October so I'll start working on this now.

Oh yes, concentrate on that. The NEWBIES thread shows you an exemplar WS and standard extra exhibits that everyone uses.

But it's seen in every DCB Legal thread.  Just read a few!  Please don't think your case is different.  You will get a discontinuance.

Hi guys, I am drafting my witness statement to send in case they don't discontinue...

One thing I've noted reading other people's WS - they are commenting on the Claimant's WS...

I don't have a WS from the Claimant?
