Mediation is best suited to finding a way through disputes where there is an agreed level of debt, but the amount disputed, like having had a new kitchen fitted, the kitchen fitter is seeking an amount above that agreed initially.

In a private car parking case, there is no debt, that can only be determined either by the acceptance of the motorist, or by a judge at a hearing. In the vast majority of cases, the motorist disagrees that there is any debt, and as mediation is prior to a judge assessing the case to determine any debt, it cannot offer anything of value to a motorist.

You should to at it with the attitude of his much are they going to pay you for the inconvenience and time wasting, after almost 6 years bringing this up is unreasonable, and a waste of your time.

    UPDATE

The mediation was a total waste of time like you've all said. Willing to reduced my fee by only £30 and suggested I settle as if they were doing me a favour. I obviously declined. Felt like the mediator was trying to scare me, she kept saying 'are you sure? are you sure? I can't guarantee anything, do you understand the risks' etc.
I said I want them to discontinue the claim as I had a valid permit and put across my all points, they immediately rejected and said they would take it further. So now just waiting for them to pay the court fee (if they ever do) and then attend court. Hoping it won't get that far though!

Its just so frustrating that they cannot give a clear answer to your reasonable questions

You don't have a 'fee'.  Don't call it that in court.

You knew she would bully you.  As seen in the Mediation Mary thread I linked.  That's what they do and why it is to be avoided.

Nor is the next stage your hearing.  Do not make that mistake!  At least ticking 'yes' to mediation was harmless.  Missing the next vital paperwork stage could be fatal to your defence.

I think you need to re-read the red CAPITALS section in the NEWBIES thread:

    IMPORTANT: KNOW WHAT HAPPENS WHEN

... because you don't just rock up at a hearing with no WS bundle having been filed & served in advance.

I'll look over it again, thank you.

Do you know by any chance how long after mediation I can expect notice from the court about a hearing date? Should I start preparing now?

Hi, I have a little update. I got the court date through but this morning DCB legal have rang me. I missed the call and they left a voicemail asking me to call them back. Should I? Or should I just ignore it? Any advice please.

    Thank you

Ignore it. They will discontinue if you do the next paperwork right.

I already advised you that a court date = WS and evidence stage (defence wasn't your only job).

Nice one. Thank you for the update. Let's get you mentioned in the DCB Legal discontinuation thread.
