UKPC court mediation

Hi,

I wondered if anyone can offer any advice. I followed all the advice in other threads about fighting my parking fine from UKPC from nearly 6 years ago and have now got to the court mediation step. I however didn't realise it wasn't mandatory, I accidentally ticked yes to it on the directions questionnaire. I suppose I just wanted to know, as its scheduled for tomorrow, whether I can just say I ticked it mistakenly and that I want to settle in court? Or should I negotiate? I don't really want to but I'm not sure what else I can say during the mediation!

    Why didn't you phone and cancel saying exactly that, that you ticked yes by mistake.

    If it goes ahead, offer £0, they won't accept, job done.

    Mediation is pointless and just wasting precious court time.

    I didn't realise it wasn't mandatory until this afternoon when I was looking at the forum for advice about how these things go and when I went back and looked at my directions questionnaire I saw I had ticked yes.

    Do you think it is too late to phone in the morning if mediation is scheduled for the afternoon, explaining the mistake and that I don't want to waste court time?

    It's the serial litigators that are wasting court time, not you OP, and they should be charged for it IMHO.

    Why not just attend, let the gits speak, and then laugh and say "no chance"?

    As long as you are a robust type who won't be bamboozled by the Mediator (clueless person) saying "you have no case and should make an offer" just say no thanks and tell us how it goes.

    If it was because a ticket machine was not working offer them the tariff for the day. If and when it goes to court you can tell the judge that you offered to pay the daily tariff.

    Out of interest, what is the big issue with mediation - is it that they might intimidate you into paying more than £0?

    However sure you are of the court decision, is there any harm in going along to mediation and sticking to what  you think you'd get at court (ie £0 or even £x nominal costs in your favour). 

    Note I'm not experienced in parking disputes, just a genuine question for the experts.

    It's a futile exercise for a parking claim as they will want 90% of the amount claimed.  

    Mediation is more suited to something like an insurance claim where the insurance company have admitted liability and made an offer but it's not enough. If talking a lot of money (person been off work a long time) it's more risky going to court so you may want to drive up the pay out at mediation.
