Struggling with templates for defence of claim for parking in a disabled space

    Just heard back from the court. It was issued on the 12th September 2023 to my old address. I wrote UK Parking Control a data rectification and SAR on the 31st March 2023 with the new address for service. They replied on the 13th April that their records had been updated and they had advised DCB Legal of the same.

    I expect a set aside is a no brainer now?

    I am confused. I looked back and you don't seem to have ever mentioned to us the clearly vital info, that you retrieved the N1 claim form from the old address.

    Of course the CNBC would continue to use that same address, if you didn't tell them to rectify it when emailing your defence.

    You will have to get the CCJ set aside now.  Send the suggested first email in the CCJ set aside section of the NEWBIES thread.

    I've not received an N1 or any court documents. 
    I got an email saying my credit file was changing, when I checked it was a CCJ from the parking fine. 
    I asked the court and found out all details were sent to the address from when I got the parking ticket.
    I'd informed the parking company of my change of address for service when I submitted by SAR. 
    There is nothing either good or bad but thinking makes it so.

    I apologise for the confusion. 

    June 23 - I filed AOS,  my defence and informed the court of my new address.

    July 23 - The claimant asked me for proof I'd paid for parking as stated in my defence, I provided this, they replied they would be proceeding with the case.

    Nov 23 I moved house and emailed DCB legal to say if they were proceeding to use my current address for service.

    A few days ago I got notice of received a CCJ, I emailed the court to find out they had been using the address from the very first claim. 


    There is nothing either good or bad but thinking makes it so.

    So you didn't tell the court that you'd moved even though the claim was live?

    In what way?  More than once?

    1.  Put the new address into a box when doing the AOS? 

    2.  Also mentioned the change of address again  in the covering email when you sent the defence?  Or emailed them separately?

    It was in the covering email sent with the AOS. I can't remember what the AOS looked like but if there was a place for address I would have put the new one in.
