Council parking fine cloned plate

My fathers vehicle number plates was cloned. We inforrmed the warwickshire and west midlands police after he got multiple fines through the post.

The vehicle is a new model ford focus same colour. It is clearly not my fathers vehicle in the images 

West midlands council and police dealth with it swiftly  warwickshire council has ignored months of letters and complaints from us about it. Ignoring the crime reference number ignoring all the images etc. It has gone as far as debt collectors. 

We also sent appeal to the TEC who rejected it! I am 100% certain they did not see any of the evidence at all. As it is clear as day and we also provided the crime reference number. They simplely do not care. They want to  scam my father..who is an old age pensioner out of hundreds.

We even asked to be given a court date and we gladly will attend and show the proof. But it just falls on deaf ears 

Litterally not one person in warwickshire council helps they have the  most heartless call center staff ever. They literally just do not care and say they want money. They dont care it is not him who has commited the crime and it is not his car. Even after providing mountains of evidence and a police crime reference number.

They also we found out sent another pcn to the balifs which they told us they had "resolved"

They clearly say my father as elderly and attacking him. 

I have ran out of options and need help to resolve this. Do i need to now go to solicitors?? Which will cost hundreds? Or do i go to the media?

If this is a genuine fine from the council, you may get more help if you head over to the PePiPoo website, as they specialise in this sort of thing.  This forum is more focussed on the fake fines issues by private parking companies.

The only advice I can offer in the meantime is don't ignore any correspondence.  Since these are genuine council fines (albeit not really meant for your father), you must at least maintain a dialogue with the council until you can get more specific advice from the guys at PePiPoo.

Hi thank you will try them. Also we have ignored nothing we responded to every request in time. Just they have ignored it there end. I have kept proof off it all

Already have made a complaint. They literally just ignored the complaint and said they cannot take complaints about PCNs or comment further.

How about contacting your local mp?, might be worth a try…or your local newspaper/ radio station, it’s amazing what a bit of negative publicity can do

You may be mixing up your abbreviations but the TEC don't handle appeals against parking fines - they are little more than a rubber stamp which allows the council to begin the enforcement process. Once the TEC are involved you are generally too late to appeal.

The actual process is to make a formal challenge to the council, then if you are not satisfied with the council's response you can make an appeal to the Traffic Penalty Tribunal, which is as close as you will get to a day in court over a parking ticket.

Have you done this? If you have been rejected by the TPT, or if the timelines for appealing to them have expired, then I think in legal terms your only option would be a judicial review of the TPT's decision. This could cost a few thousand pounds so is not something to be undertaken lightly. Assuming that isn't an option the only thing you can do is appeal to the council's better nature and/or seek to put pressure on them - eg contact your MP, your local councillor, and those "fighting for the consumer" columns in local and national newspapers.

This ticket has been going on since august 2022 so i take it we are long out of the appeal process. Speaking to the council is useless. Hundreds of calls have been made not one human with any decency listens. There excuse is you did not send us picture the vehicle in time so we dont care now its too late pay the  fine even tho it is not a crime commited by us. How a council can operate like this is beyond me.

Trying to register with pepipoo does not work. You never get the verification email. 

Looks like will have to to speak to the solicitors and local mp. I will get some letters written out.

Just shocking council and courts can scam pensioners like this and just get away with it.

It won't work with gmail addresses, and probably some others.

DO NOT REGISTER USING A MICROSOFT-HOSTED EMAIL ADDRESS (e.g. Hotmail, outlook.com, live.com, msn.com) because it won't work - you won't be able to receive emails from these forums, including the one needed to validate your account. There's a "Sticky" post in the Website Design section that explains the problem in more detail.

Nice & clear on signup page, no mention of gmail 🤷‍♀️

So if OP used gmail, check spam folder.
