  • Hi all, just an update on this case.

    All went quiet from solicitors until last week they emailed saying the 30 days has passed and I need to pay within 30 days otherwise legal proceedings could occur!

    Not sure if I should just pay this now and be done with the hassle.  Any tips?  Is it likely I will receive a court summons, and if so, could the cost increase in court and I could be ordered to pay more than the £170?
    Eh? There is no Summons.

    We win cases.  Most are likely to be struck out WITHOUT A HEARING this year.

    This is simple to defend and win when the claim form (not 'summons') arrives.  And if you were in the 1% who lose, you'd be ordered to pay LESS THAN THE CLAIM.

    This is already made clear in the NEWBIES thread.  Gladstones cases aren't easily lost!  Don't blink now!

    No. Getting a claim just means that someone is initiating a claim against you. It has no effect on anything. If you were to lose a claim after a hearing and you paid it within 30 days, there would still be no effect on your credit record. The only way anyone can get a CCJ is to lose a claim and then ignore everything after that.

    Sadly, way too many people are so unknowledgeable about basic civil law processes, no thanks to our education system, that when they eventually have a brush with it, they become completely exploitable by the devious scammers known as the unregulated private parking industry.

    Ok great, thanks.  As I only received an email (after the first letter), is this classed as a formal way of asking me to pay as I thought this all had to be done via physical letters?

    Thanks for the template, where can I find this please?

    Seems like you only skim-read the NEWBIES thread and panicked?  The Template defence is there and it's worrying me that you missed all this info.

    Sit down with a cuppa and read it. No rush.

    They are about the best way to handle all correspondence as they are fully traceable and time stamped. I you need to send anything with a "wet" signature, even better... you just save it as a PDF and attach it to an email and you then have the proof of sending and... if is not bounced back with an error in the email address, can even be deemed to have been served.
