Atlip Centre Wembley - Letter Before Claim Gladstone Solicitors

Hi All,
I'm hoping you can help me here, as I'm new to the forum and need some help!
I received a parking ticket from the Atlip Centre in December 2021, which I appealed using a template (can't remember the exact wording of the template but it was along the lines of not declaring I was the driver).
I thought that was the end of it, until last week I received a Letter Before Claim court from Gladstone Solicitors demanding £170!
It's really unfair as I was waiting on the public road for someone at the train station - I didn't think parking companies regulate public roads!
Is there any chance I can get out of this and appeal it? I have read the newbies section, but to be honest I am confused as to where to start
If anyone can direct me with the simple steps I need to follow and the templates to use, that would be most appreciated
Thanks in Advance

Thanks in AdvanceYou are assuming that Atlip road is a public highway it is not it is a Private Access Road and as such it can be controlled by a PPC.However to do this there needs to be signage to that effect and from GSV there is absolutely none, so you could be forgiven for thinking that normal highway rules apply. From a planning application proof that it is a private access road:The site is located on the north-east
side of Atlip Road (a private access
road), about 85m south of its junction
with Ealing RoadLack of signage:

Did you miss the NEWBIES FAQS sticky thread?
You sound surprised, but a LBC for £170 from tedious old Gladstones is and was fully expected. What to do is fully covered in the 2nd post there.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello, yes just found that and re-read it.Coupon-mad said:Did you miss the NEWBIES FAQS sticky thread?

these are the steps I've taken so far:
1) I've emailed Car Park Management Limited with a SAR request
2) I've also emailed Gladstones Solicitors informing them of the above.
Now I assume I just need to sit tight and wait for any correspondence - does this normally come via email or post?
Thanks!

What were you expecting Gladstones to do with that information? The advice in the NEWBIE sticky is to inform the parking company (not the solicitor) that, whilst you deny any debt, you are seeking debt advice and you require them to put the matter on hold for at least 30 days in line with the protocol for debt claims. But only do this if you want to delay the claim.supermario38 said:

I was following the newbie section. It says to request a SAR and then let the solicitors know of this.
Have I got this wrong then?0 -
This is from the newbies page:
As well as the SAR to the parking firm's DPO, also write another email, if they are using Gladstones, DCLegal, BW Legal or other solicitor.
Your email tells the solicitor:
(a) I am seeking debt advice but I deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims 2017.
(b) I have sent your client a SAR
(c) also confirm your correct 'address for service' if you've moved and the PPC has two addresses

Yes. That is what it advises. No-one said you'd got it wrong because you said you've done all that already. Good.
There wasn't anything to add. The simple steps for when you get the court claim are already in the NEWBIES thread.
I said you sounded surprised by the LBC:I thought that was the end of it, until last week I received a Letter Before Claim court from Gladstone Solicitors demanding £170!We weren't. It hadn't gone away.
This is why the NEWBIES thread covers what happens and what to do when.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
