  • Hi, I was wondering if I could get some more advice please. I submitted my witness statement, and today I received below email from Gladstones. I'm guessing it's positive but is there anything else that I need to do? Many thanks in advance! 

    'The Claimant, without intending any discourtesy, hereby gives notice that it will not not be attending the final hearing. 

    This notice is given pursuant to CPR 27.9. 

    The Court has been notified of the Claimant's non-attendance and have been asked to deal with the Claim in the Claimant's absence.'

    This is quite normal. They will probably instead send a local "hired gun." If you are lucky they won't have been handed the case until the day before and not had time to learn the detail of the case.

    Nothing unusual.

    But don't expect that there will be no-one to argue against you.
    It is quite likely that they will send an advocate to represent them.

    Oh well, I'm glad I asked, I better prepare then :) Not long to go.... Thank you again for all your help!

    Hi, one more question if I may. 

    A month ago, I received a letter from Gladstones with the cheque for the judgement amount but cheque and letter were damaged (a bottom of the cheque ripped) so was unable to cash it in. I emailed them then with the picture and provided bank details /requested re-issue of the cheque. However I had no reply for a month now.

    Not sure if anyone had the same issue. Is this really bad luck not sure. 

    I emailed them again but is there anything else I should do? The judgement I believe had something like 14 days to pay so it's overdue. And also wanted to share it in case anyone had similar experience with Gladstones.
