Company emailing for payment

I recently made a claim to my credit card company as goods purchased were damaged and faulty. I had spent many months trying to get a response from the company and felt it was my only option.

The case had all my evidence and eventually, I had my money refunded. The company is not happy and is now emailing me directly asking for the payment. They cant do this can they?

    Yes, they can.  What you do in response is up to you.  You could simply ignore it and see if they escalate.

    What happened to the goods?

    Yes they can, they can also take you to court, whether they will be successful depends on the merits of the case. Chargeback is not a legal decision, it is purely you requesting money back from a card provider and them taking the money back from the retailer.

    Hi, in your position I would turn to the Financial Ombudsman, information in following link -

    Scroll down to "Merchant Card Services".

    In the meantime, I would respond to the email/s to say that I've received their message and I am seeking further advice on the matter before proceeding further.

    I don't believe that there is any benefit in rushing into anything where finances are concerned and if you just let them know that you are doing something, they hopefully won't keep emailing. Keeping them in the loop is what you need to do while you see what the FOS has to say.

    Not sure what FOS would do. As Op would only be able to complain against their bank. Who have done nothing wrong.

    Like the Duck says -   Where are the damaged/faulty goods?  The straightforward response to the demand for payment is to invite the seller to collect or arrange return of the goods.
    I need to think of something new here...

    As per @Aylesbury_Duck and @NBLondon, what have you done with the damaged goods?

    Oh - one other question.  You haven't explicitly said, but this was a chargeback and not a s75 claim?

    Of course they can. You now have a refund AND the goods.

    You just need to write to them and ask them to collect the goods. Tell them to collect within 28 days, otherwise you will sell the goods yourself, then send them any money from the sell less an admin fee of £25. Send with proof of postage.

    If you disposed of the goods you will need to justify this.

    Would've = Would HAVE (not 'of')

    I still have the goods and told them I am happy for them to collect.
    My Credit card acted under Section 75 payment protection
