Still trying to prepare my defence.  Would this be suitable response to para 3 please.

The POC states 'the vehicle was parked in breach of the terms and conditions on signs. The Defendant asks that the Claimant provides strict proof of the breach.

Should the defence be written in single or double spacing?

    Thanks.

For UKPC/DCB Legal claims you should adapt the Defence written by @GolfR12.

    Link here https://forums.moneysavingexpert.com/discussion/6446362/uk-parking-control-limited-via-dcb-legal-ltd-defence/p1

You need to adapt paragraphs 2 and 3 to your circumstances.

For UKPC/DCBL we advise you NOT to send a SAR before you submit your defence.

Just use the one above which already attacks the POC, so you don't need to talk about the POC in para 3.

Just say the Defendant did pay and display and parked correctly in a bay so any breach is denied.

Did you ever receive anything from the claimant before the claim? Did you receive a PCN/NtK or an LoC?

    Thanks for replies.

    I received a PCN.  What's a NtK or LoC?

We were assuming you'd have read about LBC or LoC in the second post of the NEWBIES PLEASE READ THESE FAQS FIRST sticky thread.

That's the bit that is all about your stage.

As KeithP linked and signposted you to at the start of this thread, and I added:

    Coupon-mad said:
You do still need to read the 2nd post of the NEWBIES sticky and also read the Template Defence sticky, which has the first 12 steps and CCBCAQ email.

You are not at LBC or LoC stage. You told us that you are at court claim defence stage which is fully explained in the same sticky thread.

I have now received a letter from dcb legal, dated 18 July and received on 22 July asking me to phone them within 7 days to discuss settlement.  From reading previous posts am  I right to believe that I should make no contact? Thanks for any help.

Yep, ignore it and any phone calls from them unless you want to laugh at them.

  • Following submission of my defence I have now recceived a Notice of Proposed Allocation to the Small Claims Track.  It's dated 8 September and has taken 11 days to arrive.
Is this usual after submitting a defence and how best should I respond?
    Any help much appreciated.
